The Democratic aide said the articles would be announced at a news conference on Tuesday morning. The Washington Post, citing three officials, reported Monday night that the two articles were expected to allege abuse of power and obstruction of Congress. The source was cited as House Foreign Affairs Committee Chairman Eliot L. Engel (D-N.Y.). In sum, the Judiciary Committee called zero fact witnesses. There were three law professors who gave sworn testimony, but each testified that he or she had no personal knowledge of any material fact in the report. The report contains a disclaimer that it is not necessarily the opinion of the Committee, or any member of the Committee. And the Committee took sworn and unsworn testimony from the three attorneys today. While House Rule XI (j)(1) provides, "(j)(1) Whenever a hearing is conducted by a committee on a measure or matter, the minority members of the committee shall be entitled, upon request to the chair by a majority of them before the completion of the hearing, to call witnesses selected by the minority to testify with respect to that measure or matter during at least one day of hearing thereon." Chairman Nadler has so far defied GOP efforts to avail themselves of that mandatory entitlement. Some reports indicate that the two charges will be abuse of power and obstruction of Congress.
