However, Obama himself has cast doubt on that, saying he can’t pardon someone if they’re not charged. Obama's excuse is nonsense. Ford did it for Nixon. What he really can't do is pardon the foundations and pre-empt any investigation. His pardon would not prevent non-criminal investigations, and would prevent any claim of 5th amendment privilege where there is no possibility of criminal charges. Barry might have reason to want Hillary to keep her mouth shut.

#4. To: nolu chan (#1) Whatever pardon Obama does give to the Clinton's will happen only during the final week of his presidency, and more likely the last day or two. Right now he has to deal with Trump for the transition, and Obama will not make any more of his remaining term a living nightmare than necessary, not just because of Trump but because of Trump's supporters as well. Obama can also use to the time to negotiate a good deal from the Clintons.
