  • Charles Kinsey, 46, was shot in North Miami while he was on the ground with his hands up
  • Kinsey, a behavioral therapist, was attempting to calm down his 23-year-old autistic patient, who had run away from a group home
  • The therapist begs police to not shoot him — right before a North Miami officer fires three times, striking his leg
  • The object mistaken for a gun was a toy truck

An unarmed Florida therapist was shot by police while trying to calm down his autistic patient, authorities said.

Police in North Miami were responding to a report of a man with what appeared to be a gun when they came across Charles Kinsey and his patient, who had run away from a group home.

'All he has is a toy truck — a toy truck,' Kinsey pleads with cops, lying flat on the ground with arms raised, as seen in cell phone footage of the incident. 'I am a behavior therapist at a group home.'

Kinsey tries to get his patient to comply, using soothing words so he remains calm.

'Rinaldo, please be still, Rinaldo,' he is heard saying in video released by WSVN. 'Sit down, Rinaldo. Lay on your stomach.'

Therapist Charles Kinsey, 46, (left) was shot in North Miami while he was on the ground with his hands up. Throughout the ordeal, he tries to soothe his autistic patient (right), who was playing with a toy truck

Kinsey (right) recounts to a local TV station how cops shot him while on the ground and then cuffed him (left)

The man, 23, sits next to him and yells 'shut up' while playing with his toy truck.

'Don't shoot me,' Kinsey begs.

An officer then fires three times, striking Kinsey in the leg, authorities said.

No weapon was found.

Kinsey is black. Police haven't released the name or race of the officer who shot him.

Kinsey, 47, says the 911 caller must have mistaken a toy that the autistic man had for a gun.

'I'm like this right here, and when he shot me, it was so surprising,' Kinsey told WSVN.

'I thought it was a mosquito bite, and when it hit me I had my hands in the air, and I'm thinking I just got shot!

'And I'm saying, 'Sir, why did you shoot me?' and his words to me were, 'I don't know.''

Kinsey was taken to a local hospital with bullet wounds to his legs. He is expected to go home later this week

'Sir, why did you shoot me?'

Because he can.

I do not go to church every time the doors are opened, but I love Jesus Christ. I am only human and fail Him daily. I believe Jesus is the Son of God, was born of a virgin, was crucified on a cross, died for my sins and rose from the dead and that He loves us dearly, and is faithful to forgive us of our sins. But He says that if you deny me in front of your friends I will deny you in front of my Father. Can I get an Amen!

I think this comes down to you can't use cops as a catchall tool of life but people still do. If he is a mental patient then he should have been treated as such with special people(such as the therapist) to get him back to the proper place.

Right now the cops are on edge and probably treating every situation as a setup.

BTW im from Texas and that pavement must have been scorching!

I think it comes down to cops cannot shoot unarmed, wholly innocent people who present no threat, and not be imprisoned for it just like everybody else.

There is no excuse here. The cop shot somebody without justification. He must be prosecuted and punished for it.

There is no excuse.

Definitely, there is no excuse for the cop's behavior.

In this specific case I think the guy will need to charge appropriately. This is not like Michael Brown where it was self defense but well I not sure what.

Some people have no business being a police officers. This happens when you need too many officers that you have take what you can get. Too many laws to enforce and police being ask to do too much. But this is what happens when people elect the progressives(R or D) in office.

To me this is worse than when the office shot the guy in the back. When the perp fought with the officer and then ran away so the cop shot him in the back. Thats bad but somewhat understandable. The cop letting his anger get the better of him but there is one less criminal in the world.

In the other cases, there is usually a trigger, a judgment call, a non- compliance, a situation that could spiral out of control, and a cop making a snap judgment that is sometimes bad.

Some of those cases are hard ones.

Here, the only real excuse is that the cop who shot the guy didn't intend to shoot but was indiciplined and put his finger onto the trigger and accidentally shot him.

In which case he should be treated like any other accidental shooter.

It was a really bad mistake, and one of the good guys really got hurt here, and could have been killed - a friendly fire incident. Very terrible. But while the officer should not be put to death or anything, the truth is that there isn't any excuse.

His mistake will make it much harder for other cops now.

Im thinking he should not had his gun out. You pull your gun out when you think there maybe life or death situations. You point the gun when you know there could be a life or death situations. You pull the trigger when you feel there is no other choice and harm is eminent.

It gets even better - Officer Was Aiming For the Autistic Man, Shot His Unarmed Black Therapist By Accident, Says Miami Police Union Chief

John Rivera, who leads the Dade County Police Benevolent Association, explained that the police officer shot Kinsey by accident. He was actually aiming for “the white male”—Kinsey’s young autistic patient, whom the cops mistook for a suicidal man with a gun.

(In the video taken before the shooting, Kinsey calls him “Rinaldo” while trying to get him to lay on the ground so he wouldn’t be shot by the police.)

So what we have here is a cop, who is a terrible shot, who decided that a man holding a toy truck was a threat.

You know what this story proves?

If you run, police will shoot you. If you stay, lie down on the ground and put your (empty, weaponless) hands up, and comply with every single order the police give you because you are an innocent person who didn’t do anything wrong….

They will still shoot you.

All those people who say “I’m not doing anything wrong, so I have nothing to worry about” are dead wrong. We all have something to worry about in the American Police State.

"Unbelievable."

Knowing what we know now, sure. But what did the police know at the time?

They were sent to the scene as a result of 911 call reporting a man with a gun. What do they see? Two people in the middle of the street -- one laying down with his hands up pleading with another man who is holding what appears to be the gun they were told about.

One officer eventually decides to shoot the man with the "gun" and misses.

I believe that.

It was a frigging toy truck.

Considering they shot not the guy with the toy truck, but the other guy Kinsey, then handcuffed him to make it look good, the police look pretty guilty.
