Over at huffingtonpost.com, Lonnie and Sandy Phillips [above], parents of Aurora cinema massacre victim Jessica Ghawi, have penned a post decrying the outcome of their lawsuit against Lucky Gunner for selling spree killer James Holmes “armor piercing” ammunition [their term]. The Phillips lost their suit. The judge awarded the respondents a $203k settlement. TTAG reader DH has this to say about that: First, Mr. and Mrs. Phillips, I’m sorry you lost your daughter. No one should have to endure that. You may want to stop reading now . . . 2. If your suit did have merit, then in all fairness you should have also sued, the maker of the car that James Holmes used to drive there, as well as the gas station that sold him the gas, and the refiner. The City of Aurora facilitated by building the roads he used and you could probably go all the way back to the hospital where he was born, if you want to keep going down that path. 3. You shock and anger that Lucky Gunner would donate the judgement against you to gun rights groups shouldn’t come as a surprise. You attacked them in court and tried to impact their livelihood. Im guessing had you been successful in your suit, you would have donated a portion to gun control groups, including your own, to further assault the rights of Americans who choose to exercise their rights legally. I find this a bit hypocritical. 4. The party responsible for taking your daughter was caught, tried and convicted. James Holmes took her, not Lucky Gunner or any one else through negligence or malice. Again, I’m very sorry for your tragic loss. But in this particular instance. you brought this on yourselves. And while you may play the hapless victim card, you are not. You were the aggressor, and lost. 
1. Yes, the reason the judge ruled against you was that your lawsuit was frivolous. In fact, it was the very kind of lawsuit the law was created to prevent.

Followup thread. These parents were foolishly egged into an unwinnable lawsuit and now they will have to pay for the very predictable outcome. Will the usual anti-gun libs pony up the money to pay this off or leave their puppets holding the bag for the $200K?(1 image)

They can always double down and sue their lawyer for supporting their decision to sue Lucky Gunner. Of anyone, he should have known this was a frivolous suit and should have advised them of the possible negative consequences.
If he did and they still went forward, well, they only have themselves to blame.

Lawyers know when they have a live one on the hook and they carefully couch their answer to indicate they can't guarantee a result. They even tell clients they don't think they can prevail, playing them like a fiddle.

Typical liberal/progressive. They think with their heart not their head. Which is why they should never be allowed to hold position of authority. They really should not be allowed to vote because they are mentally ill!
If they were using their head they might go after the drug company or movie house who make it illegal for CHL owners to not bring in their weapon.
Truth is I take my weapon everywhere. The only place I do not carry is government building which means my gun sets in my locked truck unprotected.

Of anyone it should have been the judge who should have throw the suit out once it hit his desk. At the very minimum he should have counseled or provide someone of competence to counsel the family about the overwhelming probability that they would lose.

You're kidding,right? They exist to make their controllers rich and politically powerful from exploiting the ignorance of vapid left-wingers,not to help people. It's going to strictly be a case of "Phillips family? Who are they?"

You nailed it. Unfortunately,too many judges have their positions on the bench due to political connections,not legal knowledge.
