Title: Last Task After Layoff at Disney: Train Foreign Replacements

ORLANDO, Fla. — The employees who kept the data systems humming in the vast Walt Disney fantasy fief did not suspect trouble when they were suddenly summoned to meetings with their boss.

While families rode the Seven Dwarfs Mine Train and searched for Nemo on clamobiles in the theme parks, these workers monitored computers in industrial buildings nearby, making sure millions of Walt Disney World ticket sales, store purchases and hotel reservations went through without a hitch. Some were performing so well that they thought they had been called in for bonuses.

Instead, about 250 Disney employees were told in late October that they would be laid off. Many of their jobs were transferred to immigrants on temporary visas for highly skilled technical workers, who were brought in by an outsourcing firm based in India. Over the next three months, some Disney employees were required to train their replacements to do the jobs they had lost.

“I just couldn’t believe they could fly people in to sit at our desks and take over our jobs exactly,” said one former worker, an American in his 40s who remains unemployed since his last day at Disney on Jan. 30. “It was so humiliating to train somebody else to take over your job. I still can’t grasp it.”

The layoffs at Disney and at other companies, including the Southern California Edison power utility, are raising new questions about how businesses and outsourcing companies are using the temporary visas, known as H-1B, to place immigrants in technology jobs in the United States. These visas are at the center of a fierce debate in Congress over whether they complement American workers or displace them.

According to federal guidelines, the visas are intended for foreigners with advanced science or computer skills to fill discrete positions when American workers with those skills cannot be found. Their use, the guidelines say, should not “adversely affect the wages and working conditions” of Americans. Because of legal loopholes, however, in practice companies do not have to recruit American workers first or guarantee that Americans will not be displaced.

Too often, critics say, the visas are being used to import immigrants to do the work of Americans for less money, with laid-off American workers having to train their replacements.

“The program has created a highly lucrative business model of bringing in cheaper H-1B workers to substitute for Americans,” said Ronil Hira, a professor of public policy at Howard University who studies visa programs and has testified before Congress about H-1B visas.

A limited number of the visas, 85,000, are granted each year, and they are in hot demand. Technology giants like Microsoft, Facebook and Google repeatedly press for increases in the annual quotas, saying there are not enough Americans with the skills they need.

Many American companies use H-1B visas to bring in small numbers of foreigners for openings demanding specialized skills, according to official reports. But for years most top recipients of the visas have been outsourcing or consulting firms based in India, or their American subsidiaries, which import workers for large contracts to take over entire in-house technology units — and to cut costs. The immigrants are employees of the outsourcing companies.

In 2013, those firms — including Infosys, Tata Consultancy Services and HCL America, the company hired by Disney — were six of the top 10 companies granted H-1Bs, with each one receiving more than one thousand visas.

H-1B immigrants work for less than American tech workers, Professor Hira said at a hearing in March of the Senate Judiciary Committee, because of weaknesses in wage regulations. The savings have been 25 percent to 49 percent less in recent cases, he told lawmakers.

Be interesting to see who the supporters of this are. Also, its not just Disney that is replacing domestic employees with newly brought in foreigners.

Capitalism!

A more accurate term is "Affirmative Action Capitalism."

Last time I was at Disney with the family there were not many American families vacationing there. Most were from other countries and speaking different languages. So maybe having foreign workers there who speak those languages helps Disney. Dunno.

Any kid taking up computer programming and information technology in college is nuts. He's setting himself to be replaced by a dumbass brought in from a foreign country who works at 1/3 salary and screws everything up.

I used to order books and CDs from a particular company. The ordering program was flawless and easy to use. Last year I ordered about $500 worth of books through them. Amen to that. Back 20 years ago IT was inhabited by individuals who could do and perform. There was a time when BS and buzzwords didn't compile.

Today it's increasingly the domain of bullshyte artists who think its clever that they cheated their way through college and know little more than lots of buzzwords.

Knowing lots of buzzwords doesn't keep their AML (Anti Money Laundering) SQL from taking hours to run. Just a coinkidink?

Capitalism!

It's not capitalism, it's the result of misguided government programs like H1B.

H1B was originally an immigration program to bring the best and brightest tech people to the U.S. Having the best and brightest people in the world migrate to America is a good thing. BUT THAT IS NOT WHAT IS HAPPENING TODAY.

Today H1B is used by Indian technology services companies gain competitive advantage over America technology services companies. They flood the market with cheap, inexperience people and back them up with large numbers of even cheaper people in India. H1B is not even an immigration program any longer, as only 2% of H1Bs who work for these Indian companies apply to become permanent residents. H1Bs who work for Indian companies come here for 4 to 5 years to learn how to compete against us and then go back home to assume leadership positions managing the yokels back home.

It's not only H1B. Indian companies have been shown to be cheat on L1 visas as well.

We need to eliminate the government H1B program and crack down on Indian companies cheating on the government L1 visa program.

Unfortunately, a broad swath of Democrats and Republicans are completely clueless and continue to support H1B. In fact, there is a bill in Congress to more than quadruple the number of H1Bs we let into the country each year.

The government created this situation and it needs to end it.

Not saying government is not needed because clearly we need several layers of government. If we had a real government of the people for the people and by the people this garbage would not happen.

For the last number of years, he's been watching all his guys under him get replaced, after they trained their replacements, and yes, they were from India.

Oh, I asked him how he felt about this as it was going on, he was real ok with it, heck, he traveled to India a few times a year, went first class, said he loved that 3rd world cesspool, everything was wonderful. Myself, I thought he was a POS for being so cavalier about what he was a part of, but bit my tongue for peace in the family.

Well, now that they have seen fit to eliminate him from his work, and get replaced by a wonderful Indian guy, I can't help but laugh at him. He was about six months from 20 years also, and somehow, that put a real hemmerhroid on his retirement plans. Almost brought a tear to my eye. (Not really)

You make the typical mistake of the novice leftist, whether because of ignorance or dishonesty is of no matter to me.

It's cronyism, not capitalism.

Check...and MATE.

You GOP morons serve as useful idiots to capitalists though. You useful idiots always mention how the New Testament is anti-gay - and its - and ignore the Jesus condemned the rich and the worldly and markets of the money changers and how he was pro poor at the expense of the rich.

Congratulations! With this stunning display of MSNBC-type of "analysis" you've managed to hit the trifecta of liberal-socialist myth, lies, and wishful thinking.

To: Dead Culture Watch You are the fools defending this mythical capitalism.

What fantasy notion of capitalism do you have where owners cherish workers enough to not under cut them with cheaper labor?

It's OK if the owners do it to factory workers but once they do it to skilled middle class college educated labor suddenly you lot get upset?

OK you pompous, shallow thinking child.

Enough of the BS you spew! What we have is the best system that can be had, perfect? NO, HELL NO!!

But it was a system that made your entire cushy existence possible, and only a complete imbecile would think otherwise.

Or, do you REALLY believe the computer you type your tripe would have ever been possible with a commie system? I truly believe you don't think about uncomfortable things such as this.

Oh, all that's gonna leave yet another mark on the imbecile. Heh! (with all due respect to Curly.)

Pericles is Exhibit "A" of the typical lib-commie's aversion to reality. AS he strolls thru a fully stocked supermarket..... drives his Lincoln...home to his air-conditioned home...plops at his desk...and taps keys on his computer.

I have a old friend who is a typical lib college prof ("teaching" young pods about the "rights" of transvestism and homosexuality, and the "evils" of capitalism, heterosexuals, and Christians.) This same hypocrite extolls the very same political positions of Pericles...from the luxury of his burb home as he drives two vehicles (one electric of course), pops open bottles of aged wine and he cheers on the Mets on his Big Screen Tee-Bee.

Speaking of "useful idiots"...

"Mention"? No, we merely reinforce both the Old *and* New Testament's clear condemnation of sodomites (is "gay rights" now a new, trendy crusade for you and your fellow propagandists??)

Jesus condemned the love of money, and the money changers who tried to turn the Temple of the Lord into an outdoors mall.

Jesus did not discriminate against nor favor *any* class of people -- neither the poor OR rich. The poor are no more noble nor have a pipeline to heaven then anyone else.

Maybe you should try understanding the Bible and scripture beyond a purely Marxist perspective. It might help you address your deceptions, hatred, and false notion of the Gospel.

How many Union employees have lost their jobs in the USA because the Union bosses were getting rich shipping those jobs overseas?

Millions, but don't tell Pericles that he's in denial.

Did you notice that the others here who have the same ideology as his have stayed away from this thread?

BTW, I've known a number of people who have worked at Disney studios through the years, all the way from illustrators to gophers, and to a man, they all thought of the place as the worst studio in LA to work in, and by a long shot.

How many Union employees lost their jobs because the GOP went after the power of the unions?

When we had more people in unions Americans had a better economy. As soon as we started to have less union labor the income gap increased.

Now that they are dome exporting blue collar jobs out they are going after the wehite collar jobs and now the GOP rank and file feel betrayed. Enjoy! How's that capitalism treating your outsourced job? Can't find work in your chosen profession? Tough shit - the world needs ditch diggers, too! Oh, wait that is a job for illegal alien labor.

Do you really think anybody believes the economy is tied to Union membership when it's just the opposite. And since you haven't figured it out yet non-union people can actually be better off financially than union people even though they may make less per hour. It's because they don't have to pay outrageous union dues dummy!

You know I'm curious as to why the people you (and union people) vote for are trashing the economy and putting the "Union Brethren" out of work and on Welfare and Food Stamps? (Talk about being thrown under the "high speed rail" train/bus). Look what all those union dues have gotten them and they haven't figured out yet they've been screwed. Maybe one day they will wise up but I'm not counting on it, they believe the lies as much as you do.

You keep saying this after Disney did this to good jobs staffed by educated college white collar employees who had no union protection. How long will you believe in your false god and make excuses?

What's happening in this country is due TO BOTH PARTIES.

The fact I even need to type that, let alone capitalize it for you makes me feel sorry for you. When you take off your stupid colored glasses, maybe we can talk like civilized adults about this, until then, don't expect much patience from me, the needs I must attend to on a daily basis leave me little energy to be more civil to those I believe are willingly ignorant or obtuse.

Capitalism works in these cases exactly the way it should. GOVERNMENT is the problem. They should be #1: protecting our borders, controlling immigration tightly and intelligently. #2: Have a system of tariffs and import/export taxes in place to protect jobs and ensure quality of imports. The government is not in place to protect the profits and ensure the safe conduct of business/commerce outside the US borders. It is in place to protect the people living legally within its borders, abiding by its laws.
