Bang / Guns Title: Texas open carry activists unlawfully arrested against state penal codes ARLINGTON, Tex. (INTELLIHUB) — Unfortunately a few open carry activists standing up for their rights found out the hard way, that we simply don’t live in a free society anymore, after a few were unlawfully arrested for carrying pre-1899 black powder antique pistols against the state penal codes 46.01 and 46.02.
This all started when a group of open carry activists were seen filming a police traffic stop from afar, across a busy city street, by a few cops passing by in their police cruiser. Soon after two officers crossed the street illegally and proceeded to harass several members of the group. “They’re coming for us.”, one if the activists said. One of the police officers, officer Kent, approached the group saying, “All right guys listen up. One warning, this is the only one. I need you to go back and put your weapons up if you are armed. Go back to your vehicle and put your weapons up.” One of the activists, a female, spoke up, informing the officers, “It’s state penal code 46.01 and 46.02 sir. It’s according to the penal code, it’s a black powder pistol. It’s not center fire or rim-fired.” Officer Deary then piped up, “I can’t tell that unless I am able to see it.” “It’s legal to carry.”, said another activist who was present. Then after another moment passed the officers proceeded to harass a few other members of the group which were lawfully carrying black power pistols and a long-gun just steps away. “Alright guys that was it, you got one shot, put it back in your vehicle”, officer Kent instructed one of the activists. When the activist responded to the officer by saying, “You said you were only going to tell again, so now you’re lying. So go somewhere else.”, the officer didn’t like his comment and nodded to the other officer to proceed. The police may have violated his right to carry. At the same time, these people wanted to be arrested. The guy who didn't get back when the police officer told him to get back. That was maybe a legitimate arrest. I don't know the law. But it seems to me that it is reasonable for the officer to not want the guy right up on him when he is making an arrest. With police being shot these days. It is reasonable for them to be careful and prudent. I know we have second amendment rights. I also see with all the violence today that people driving down the road might be concerned about getting shot when people are demonstrating like that. So there really aren't any perfect solutions. You seem to always be against the police. Some seem to always stick up for the police. We all have our predispositions. Have the police ever abused you or violated your rights personally?

I also see with all the violence today that people driving down the road might be concerned about getting shot when people are demonstrating like that. So it is your contention that we are only "allowed" to exercise those rights when we are granted "permission" to do so and only if no one else is "offended"? The gun owners have every right to carry. The cop should know what the laws are, don't you agree?

No that is not my contention. I'm more of a rebel then that. What I am saying. Us being human beings cannot form a perfect form of government. We can't get it right. Even if we drafted up the perfect laws people would still manipulate and lie about what those words meant. I agree you should be able to carry your gun. So it was probably a violation. But the constitution wasn't written so some guys could go sit on the side of the road and play gotya with the police. The second amendment recognizes that we have a right to have arms in order to defend us from a corrupt government. We're never going get it right or all be happy about it.

I'm glad I live in an open carry state (I moved from nazi NY on the day I retired) And I'm glad I don't have to deal with people that do play gotya, while you're trying to do your job.

If the Constitution was honored, people would be carrying as a matter of normality, and police wouldn't bat an eye. -- Instead the cops would be able to do their jobs, as peacekeepers, with armed citizens as backup.
#10. To: tpaine (#7) Yes that seems to be a big issue in the country, legislatures making Unconstitutional laws and police enforcing them. Too bad there aren't enough people out there willing to put an end to all that, but the corruption has infiltrated to the highest levels and the only way things will be set right is if a WHOLE LOT OF BLOOD FLOWS!!!!!!!!
