The U.S. Supreme Court backed the use of strip searches of newly arrested people, saying jails can take steps to ensure that even those arrested for minor offenses aren’t smuggling in weapons or drugs.

Ruling in a case that pitted security concerns against privacy rights, the justices today said in a 5-4 vote that officials don’t need individualized suspicion before conducting searches that involve close inspection of private body parts.

Two members of the majority -- Chief Justice John Roberts and Justice Samuel Alito -- wrote separately to say the decision was a limited one. Roberts said the ruling left open the possibility of exceptions, while Alito said it was limited to newly arrested inmates who are admitted into the prison’s general population.

“Jails are often crowded, unsanitary and dangerous places,” Justice Anthony Kennedy wrote for the court. “There is a substantial interest in preventing any new inmate, either of his own will or as a result of coercion, from putting all who live or work at these institutions at even greater risk when he is admitted to the general population.”

The case split the court along ideological lines, with Justices Antonin Scalia and Clarence Thomas joining the majority.

Fourth Amendment – Protection from unreasonable search and seizure.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Well there is a right to privacy, the 4th amendment but it can't apply to prisoners. We should have a LOT less people in jail, and a much better justice system, IMO. The present system is payola to the correctional officers union, lawyers unions, and court employee's unions, police union, graft, corruption, and fraud.

Oh, I forgot the teachers union, to get them plugged into the system. My bad.

PRIVACY is NOT mentioned anywhere there in the 4th Amendment.

Do you see the word PRIVACY? in the 4th Amendment? In the US CONSTITUTION?

NO, you sure F'ing do NOT.

In fact, no so called federal "right" to PRIVACY has ever been held to spring from what is written ANYWHERE in the founding documents.

The reason that I know this is because the 1959 CONSTITUTION of the State of Alaska contains a RIGHT TO PRIVACY that the US CONSTITUTION does NOT contain.

All that the 4th Amendment does by TRADITION and PRACTICE is to describe exactly how to violate your non existent "right" to PRIVACY by sworn warrants based on so called "probable cause".

Ask ANY educated US CONSTITUTIONAL lawyer, there is no such thing as a right to PRIVACY in the Federal CONSTITUTION.

Sorry that you are so ignorant about basic FACTS about the US CONSTITUTION.
