Corrupt Government Title: El Paso Mayor to Indict Voters Who Don't Support His Agenda? By Joshua Zuber and Eighth Court of Appeals, City of El Paso EL PASO, Texas The ruling came down from the 8th Court of Appeals Friday. Mayor John Cook won his appeal in his lawsuit against a group seeking to recall him. In 2011, Pastorn Tom Brown started the effort to recall Cook, and city representatives Susie Byrd and Steve Ortega after the city council overturned an initiative passed by voters to end benefits for gay and unmarried partners of city employees along with a number of retired city workers. Cook then sued Brown and Municipal Clerk Richarda Momsen in an attempt to halt the recall election because, he said, those signatures were obtained illegally on church property. In an interview on Jan. 17, Cook said, "I think it was important to bring up the fact that whether it's someone buying votes or illegally collecting signatures, is the same thing if it's violating the election code." The 8th Court of Appeals ruled that the El Pasoans for Traditional Family Values recall group had violated the law in its petition drive. The court also ordered Momsen to decertify the recall petitions and ruled that no recall election using them can be held. Cook's and Brown's attorneys, Mark Walker and Joel Oster, each had a different take on Friday's ruling. They said all three judges ruled in an unanimous decision that Brown and others named in Cook's lawsuit illegally used churches to get people to sign petitions to recall the mayor and two city representatives. Cook, who was in San Antonio when the ruling was announced, said he's clearly happy about the victory. He plans on working to get back the more than $225,000 in attorney's fees that he incurred in the lawsuit. "I think it will be our intention to ask for legal fees and damages so that the losers in the appeals court will be the ones who have to pay," said Cook. KFOX14 contacted Brown and spoke to him over the phone Friday, but he declined an on-camera interview, saying he can't talk about ongoing litigation. This was the first time he's ever declined an on-camera interview with KFOX14 for that reason. "We anticipated this. We have political corruption in El Paso. This could be a blessing in disguise, to move it to Austin," said Brown. Brown and Oster plan to appeal Friday's decision to the Texas Supreme Court. Cook and Walker said they have no ground on which to appeal because the ruling was unanimous. A city spokesperson told KFOX14 on Monday the city's Attorney's Office will review the ruling and likely follow the court order to not hold the recall election. The court also ruled that County Court 3 Judge Javier Alvarez abused his discretion in denying Cook's request for an injunction.
