March 12, 2012 by Giacomo Abby Johnson use to serve as the director of Planned Parenthood in Bryan/College Station, Texas. Drawing upon the Federal False Claims Act and the Texas Medicaid Fraud Protection Act, Johnson has brought a lawsuit against Planned Parenthood in Texas, accusing them of making as many as 87,000 fraudulent claims against Medicaid through the Texas Women’s Health Program. Johnson was an ardent supporter of abortion and worked with Planned Parenthood until she was called in to assist in an abortion. During this particular abortion, she watched a monitor that showed the unborn baby struggle and fight for its life before being brutally murdered. This was a life changing experience for her and she left the abortion industry. Once Johnson realized what abortion was actually doing, she turned against the organization and filed the legal action against them. According to Johnson, from 2007 to 2009, Planned Parenthood filed 87,075 claims with the Texas Women’s Health Program that were fraudulent, false or ineligible netting the organization close to $6 million. If found guilty, Planned Parenthood could be ordered to pay up to $11,000 per claim totaling $958 million in fines. The case, which was filed with the help of the Alliance Defense Fund stated if,
“Any person who knowingly submits or causes to be submitted a false or fraudulent claim to the government for payment or approval is liable for civil penalty up to $11,000 for each such claim submitted or paid, plus three times the amount of the damages sustained by the government… “Liability attaches both when a defendant knowingly seeks payment that is unwarranted from the government and when false records or statements are knowingly created or caused to be used to conceal, avoid, or decrease an obligation to pay or transmit money to the government.”
Johnson’s statement says that Planned Parenthood knowingly instructed employees to file the fraudulent claims by making every visit to the clinic a revenue generating visit,
“Planned Parenthood initiated a scheme of fraudulent billing to offset its operating losses. This fraudulent billing was accomplished by assigning a fraudulent purpose for a patient visit that would otherwise be non-billable. For example, a woman with an infection would not be eligible for a follow-up examination paid by WHP, since the exam must be with regard to family planning services, not general obstetrical care. … As instructed by Planned Parenthood, Ms. Johnson and others falsely notated the patient’s chart with services not, in fact, provided to the patient so as to create an otherwise non-reimbursable service into a reimbursable family planning product or service.” The fraudulent claims are what prompted the Texas legislature to recently block all funding for Planned Parenthood through the Texas Women’s Health Program. Not only is Planned Parenthood guilty of thousands of murders, but they also appear to be guilty of thousands of cases of felony fraud that has cost taxpayers millions of dollars. In most instances, such an organization would be shut down. However, they seem to have the special protection of the most liberal presidential administration in America’s history. It wouldn’t surprise me to see the Department of Justice step in to help protect Planned Parenthood from the pending lawsuit. Personally, I would love to see a judge find them guilty and throw the book at them, fining them the maximum amount possible, which should bankrupt the murderous organization and put them out of business, at least in the state of Texas.
