Police Civil Asset Forfeitures Exceed All Burglaries in 2014

Well, it turns out that cops steal more money from American people than thieves do. Between 1989 and 2010, U.S. attorneys seized an estimated $12.6 billion in asset forfeiture cases. The growth rate during that time averaged +19.4% annually. In 2010 alone, the value of assets seized grew by +52.8% from 2009 and was six times greater than the total for 1989. Then by 2014, that number had ballooned to roughly $4.5 billion for the year, making this 35% of the entire number of assets collected from 1989 to 2010 in a single year. According to the FBI, the total amount of goods stolen by criminals in 2014 burglary offenses suffered an estimated $3.9 billion in property losses. ...

On this day, November 16, 217 years ago, Governor James Garrard of Kentucky signed into law the first of two landmark pieces of legislation known to history as the Kentucky Resolutions. The first bill was passed by tthe Kentucky state House on November 10, 1798 and by the Senate on November 13. The bill was then signed into law by Governor Garrard three days later. As is widely known, the Kentucky Resolution of 1798 was authored by Thomas Jefferson (shown), while a companion measure introduced in the Virginia state assembly was written by his frequent collaborator, James Madison. The measures were reactions by the two first-tier Founders to the enactment by President John Adams of the ...

Fixing The Cop Problem

That we have a Cop Problem is obvious. How to fix it, not so much. The problem – a chunk of it, at any rate – derives from an overweening postmodern concern for the “safety” of cops to the detriment of those they (ahem) serve. Plus what’s known in the lawyer game as qualified or (worse) sovereign immunity. It means they get away with doing things that would ruin ordinary people who did exactly the same things. It’s a crazy idea. If, that is, you don’t want to end up with a Cop Problem. Take any group of people and make it known that even when they do something criminal, they will be held less responsible for the doing of it – and what do you ...

Hundreds of residents packed a town hall meeting in Idaho yesterday asking tough questions of their county’s sheriff after two deputies fatally shot a local rancher.Over 200 residents from the town of Council voiced concerns over the death of Jack Yantis, the rancher killed by deputies last week, with some leaving the assembly angry over the answers Adams County Sheriff Ryan Zollman gave. Police had first claimed that Yantis, 62, engaged in a fire fight with Adams County Sheriffs deputies last Monday on US Route 95 after being summoned to deal with his injured and aggravated two-ton Angus bull. But Yantis’ daughter, Sarah, says there was no such gun fight, and instead called ...

WASHINGTON — President Obama bestowed the nation's highest military honor on an Army Captain who rushed a suicide bomber attacking his patrol in Afghanistan three years ago. But retired Army Capt. Florent Groberg said the Congressional Medal of Honor doesn't belong to him. "This medal belongs to the true heroes," he said. "It also belongs to their families, true heroes who live with that day every day missing one of the members of their families." Those heroes, he said, are the four other Americans killed in the attack: Army Command Sgt. Major Kevin Griffin, Army Major Thomas Kennedy, Air Force Major Walter Gray and U.S. Agency for International ...

from the we'll-assault-you-and-your-house-in-public,-but-please-don't-record-us dept For many years, law enforcement agencies used (mostly outdated) wiretapping laws to justify arrests and prosecutions of citizens who recorded them during their public duties. For a long time, they succeeded, with Illinois seeing a great many of these thanks to its (unconstitutional) law. That law has since been nullified by the courts, but there are still a few legacy laws out there being abused to shut down recordings of police officers. Another win has arrived for citizens who play an key part in the law enforcement accountability process. Photography Is Not A Crime reports that New Hampshire ...

Police Can Take Your Stuff for No Reason — And the Practice Is on the Rise

In addition to a lot of other things police have the power to do, they can take your cash, cars, and other personal property even if you've never been charged or convicted of a crime  — a practice that has been on the rise in recent years. This controversial practice is known as civil asset forfeiture. Not only does it allow cops to take your stuff pretty much when they feel like it, the revenue from what they take goes toward those very local law enforcement agencies seizing it. Over the past decade, this practice has gone up nearly sixfold, according to a report released Tuesday by the Institute for Justice, a legal non-profit that focuses on civil liberties ...

It’s been an interesting weekend for Ben Carson. Friday morning, Politico broke a story that Carson had supposedly lied about applying and being accepted to West Point. Many people thought his campaign was dead then and there. But by the afternoon, the conservative pushback had begun and Carson’s supporters were able to partially rebut the sloppy reporting. Carson turned defeat into a victory, raising $3.5 million in a week, most likely because his supporters were so infuriated at the attacks of the Main Stream Media [Carson Raises $3.5 million this week amidst media scrutiny, by Jonah Bennett, Daily Caller, November 7, 2015] And it was unfair. The Bureau of Land Management (BLM), the federal agency tasked with sustaining the health, diversity, and productivity of America’s public lands, has been implicated in a scheme to illegally sell captured wild horses to a Colorado rancher, who then sold the animals for slaughter. One of the BLM’s duties is to protect the herds of wild horses that roam freely in the Southwestern Unites States. However, an investigation by the Office of the Inspector General of the U.S. Department of the Interior revealed that the BLM had sold approximately 1,800 wild horses to rancher Tom Davis, who then promptly sent the horses to be slaughtered in Mexico.“Managers … failed to enforce ...

Ed Krayewski blogged about this shooting when it happened earlier this year. Officer Lisa Mearkle of Hummelstown, Pennsylvania, was hunting David Kassick through the Pennsylvania snow as if he were a frightened deer. Why was this paladin of public safety doing this? Because she saw Kassick had an expired inspection and emission test stickers on his car. When she tried to pull him over for it he kept driving, eventually to his sister's house, then got out of the car and continued to try to move toward safety for himself and not quietly let her apprehend him. She tased him, he was writhing on the ground, she screamed at him loud and long about showing his hands and not moving and then ...

Cities claim it’s all about protecting public safety from the hazards of poorly maintained property, but anybody who has ever had to interact with this system knows that it’s all about either using government force to protect property values (as though that’s an appropriate role of police authority) or finding new ways to milk citizens of money. And that’s not even getting into situations where citizens use it to tattle on neighbors to perpetuate feuds.
