An illegal alien who was set free by a sanctuary city and never deported is charged with killing a man just weeks after his release.

Ever Valles, 19, murdered Timothy Cruz, 32, on Feb. 7 after robbing him at a train station, police say. He had been released by the Denver Sheriff's Department just six weeks before that after posting $5,000 bond on charges of theft.

Denver released Valles even though U.S. Immigration and Customs Enforcement (ICE) agents asked the city to hold him. In fact, ICE had flagged Valles as an "immigration priority" given his ties to gang activity in the city and asked to be told before his release so they could arrest him themselves.

Valles is now charged with first-degree robbery and murder along with Nathan Valdez, a 19-year-old U.S. citizen.

Denver Sheriff's Department is standing by its decision to set Valles free.

"Denver has never and will never condone dangerous or violent individuals being on our streets, immigrants or not, however, detaining anyone without a criminal warrant is a violation of the Fourth Amendment of the U.S. Constitution," a statement read.

ICE officials, though, say the city failed to keep its deal. "The detainer wasn´t honored and he was released by the jail ... without prior notification. Valles is a known gang member whose gang history is documented in the Colorado gang database," the agency said.

As President Trump seeks to crack down on sanctuary cities -- where illegal aliens can often escape the reach of the federal government and avoid deportation -- Denver Mayor Michael Hancock embracing the idea.

"If being a sanctuary city means that we value taking care of one another, and welcoming refugees and immigrants, then I welcome the title. If being a sanctuary city means families and young ‘Dreamers’ live with hope and not fear, then Washington can label us whatever they want," he said.

Poster Comment:

I think this will be the go-to case when conservatives and the WH argue against sanctuary cities. We're going to know the name Ever Valles.

No doubt, there are other similar cases that can be dug up.

Denver? The city of legal pot and over 600 dispensaries? Stupid, stupid, stupid.

When you're already operating contrary to federal law, it's not a good idea to spit in the face of the entity that is allowing you to do so with a wink and a nudge.

All Trump has to do is instruct the DOJ to enforce the existing law and bring in the DEA in force. That's it. No Congress. No executive order. No courts to appeal to.

NYPost today:

‘Sanctuary city’ law let gang member walk free from Rikers

An illegal immigrant gang member from El Salvador was allowed to walk free from Rikers Island under Mayor Bill de Blasio’s “Sanctuary City” law — in defiance of a federal petition to hold him for deportation, officials said Tuesday.

“This man is by his own admission a member of a violent street gang and he was released back into the community,” said Thomas Decker, field office director for the US Immigration and Customs Enforcement unit in New York. “Honoring a detainer request is not about politics, it is about keeping New York citizens safe.”

Estivan Rafael Marques Velasquez, an admitted member of the notorious MS-13 gang, was released from Rikers Island on Feb. 16 after serving time for disorderly conduct.

ICE officials had requested last May that Velasquez — who was ordered removed by an immigration judge in November 2015 — be turned over to them when he was done serving his sentence, but no one at ICE was alerted to his release.

They were forced to send their own agents to find him, and they were able to track him down the same day in Queens.

“He has been processed and is now in … detention pending removal,” ICE said in a statement Tuesday.

The 19-year-old Salvadoran national has a criminal history in the United States that includes second-degree reckless endangerment, fourth-degree criminal possession of a weapon and disorderly conduct, federal officials said.

Politically, a bad idea. That ship has already sailed. And this article has nothing to do with pot in Colorado, even if you want to vent about ganja on any thread that contains the words "Denver" or "Colorado".

Congress should decriminalize pot by reclassifying it as a non-Schedule I drug and otherwise send it back to the states to deal with.

I'll mention that 8 states already have established recreational pot laws and a decent majority have legalized medical cannabis.

" Denver Sheriff's Department is standing by its decision to set Valles free. "

Fine. Charge everyone involved, from the Mayor to the Deputies, with Accessory to Murder. Although to be fair, I suspect the Deputies are not fond of the policy! But am sure the family of the man murdered want to see justice done.

Illegal Alien Released By Sanctuary City Now Charged With Murder

The sanctuary advocates in cahoots with this decision should be charged with being accessories and prosecuted to the full extent of the law.

"Politically, a bad idea. That ship has already sailed."

That ship sailed under Captain Obama. We now have a new captain.

"Congress should decriminalize pot by reclassifying it as a non- Schedule I drug and otherwise send it back to the states to deal with."

They could. They could have done that any time since the CSA was passed in 1970. But they didn't.

So I say enforce the current law an and start with Denver. The other states will get the message.

You and almost nobody else. You drug warriors are a dying breed.

I wouldn't hold my breath waiting for Sessions to go after the pot industry in Colorado. And the longer he waits, the less likely it is that he will try.

I would look for some legal harassment of growers and dispensaries on tax laws and banking, much as 0bama lamely tried to do.

Wasn't he the guy who said if Americans don’t want him to enforce marijuana laws, they should change them? Makes sense to me.

Anyways, if Denver keeps poking the bear they're going to get bit. Keep in mind, Trump ran as a law and order guy.

He did. I also think he'll go after a lot of other crime first.

Keep in mind, Trump ran as a law and order guy.

True. However, if recreational pot is again criminalized in Colorado and the other 7 recreational pot states, you will inevitably see gangs fighting over pot distribution territories again. Meaning that it isn't so simple as just raiding the dispensaries. And many growers anticipated such a crackdown and have taken measures to keep operating on the black market.

It won't be as easy or tidy as you think. Sessions knows this, even if you don't.

Unless you know something I don't know, I don't see how enforcing the law in Colorado would lead to a worse situation than before.

Unless you know something I don't know, I don't see how enforcing the law in Colorado would lead to a worse situation than before.

The young alt-right voters that are slowing growing slowly among the millennials are opposed to going back to a full War On Drugs on pot. The GOP can't risk losing that sliver of the youth vote that is alt-right or libertarian. They are not Religious Right voters or traditionalists at all.

I know that argument won't impress the Old Bastards Club here at LF but, like the O'Reilly audience, that is a group whose median age is about 72. The GOP needs to consider who the hell will vote for them as the last of the WW II and Korea generation is gone. And we lose Vietnam vets from the voter pool every day too.

I think it's pretty much suicidal to try to outlaw pot again. Better to decriminalize it and then ignore it. The feds should concentrate on opiate abuse and other prescription drug abuse that actually do kill tens of thousands of Americans per year. And pot doesn't.

You aren't going to change the minds of the millennials on this issue, just like you aren't going to turn back the clock on sodomy marriage. I can at least imagine overturning Roe. I find it a lot harder to see sodomy marriage reversed or any full-scale enforcement actions against the pot industry.

"Better to decriminalize it"

Fine. As long as it's remains illegal.
