Castile

The Second Amendment exists, and it isn't just for white Americans. In the wake of the Philando Castile shooting, the police need reminding of that.

But perhaps some gun rights advocates need reminding of that as well.

As reported at Reason and elsewhere, Castile was shot by a police officer near St. Paul, Minnesota, after he reached for his wallet in order to produce his concealed carry permit. Cops then detained his girlfriend and her young daughter—who were in the car at the time—as Castile bled to death. Other officers comforted the cop who shot Castile, but no one bothered to assist the dying man, or even check his pulse.

During a subsequent press conference, Diamond Reynolds—Castile's girlfriend—insisted that he had done nothing wrong. And she's right. They were stopped because their car had a broken tail light. That's it.

In Minnesota, citizens are allowed to carry firearms if they have a permit to do so. Castile was merely exercising his Second Amendment rights. His decision to inform the officer about his weapon was courteous, but not legally required. Permit holders in Minnesota do not need to tell cops that they are carrying firearms unless specifically asked.

It seems fairly clearly, then, that Castile is in some sense a Second Amendment martyr: He was killed by a police officer because he was exercising his rights. We know, of course, that these kinds of things are more likely to happen to black Americans, regardless of whether they were doing anything wrong.

I would think it would be the easiest thing in the world for gun rights advocates to condemn this senseless killing. And yet, as I write this, the most important gun rights organization in the country hasn't said a word. The NRA's Twitter feed makes no mention of the Castile shooting, even though it's been a trending topic all day.

National Review's Charles Cooke cautions against instinctively blaming the NRA whenever there's a shooting, and of course he's right. But I would expect the organization to at last express some outrage that an agent of the state killed a man, in no small part because the man was carrying a legal firearm. Cooke also observes:

In my view, too many conservatives react to these stories by presuming that the police must have got it right. I understand how irritating it is to hear the argument that "cop X was bad, therefore cops are generally bad," but it is equally fallacious to contend that "cops are generally good, so cop X must have been good." There is, I'm afraid, some truth in the charge that conservatives are skeptical of government up until the point that the police or the army are involved. 

The Castile shooting—as horrible as it is—provides a perfect opportunity for civil liberties advocates on the right and left to come together and condemn government overreach that resulted in the death of a man who did nothing wrong. It's a moment to reaffirm that Constitutional rights should be enjoyed by all people equally, regardless of race.

As Fusion.com points out, the fact the NRA has commented on the Dallas police officers’ deaths but not the death of a black man licensed to carry a gun is not surprising. Second Amendment protections have often been denied to black citizens. Martin Luther King, Jr. couldn’t even get a concealed carry permit after his life was threatened. The NRA has historically not commented on individual or mass shootings, but the NRA does have a close if fraught relationship with American police forces.

The only person closely related to the NRA to speak out for Philando Castile was Cam Edwards, host of the Cam&Co NRA podcast, who told listeners on Thursday: ‘What we know does not look good. Our right to keep and bear arms is not based on the color of our skin.’

After news of its members becoming outraged over their silence, the NRA released a statement Friday afternoon that resembles more of a police department statement than anything else.

My thought on this is to move cautiously. Wait till the facts are known not just hearsay.

If it is to be found that the officer fucked up then the NRA should speak out but premature speculation should be avoided.

Every citizen has a right to protect themselves even officers.

To me from just the little reading I have done because im really sick of this shit!

The officer was nervous for some reason and the Philando really did not understand what to do when identifying he has a CHL. Here in Texas they say have both license out with both hands on steering wheel or dash as to help the officer know you are no threat to him.

That's what the girlfriend said. And she's lying.

According to the police scanner audio, they were pulled over because the driver looked like one of the BOLO suspects in a recent armed robbery four blocks away.

The driver had a gun in his lap and refused the officer's orders not to reach for it.

As far as the police officers knew, it could have been one of those trick guns that's actually a cigarette lighter, and he could have been just reaching for it to light up a stolen Newport. The officers should have waited for him to fire on them to be sure.

A KARE 11 viewer, who gave us audio clips of police radio traffic, claims they captured the moments just before Philando Castile and his girlfriend were stopped by St. Anthony police – which ended in police shooting that killed Castile.

KARE 11 has attempted to confirm the authenticity of the recording with police officials, but so far they have not responded.

We have verified that the license plate mentioned by police in the recording matches the plate of the car Castile was driving. The location the officer gives also corresponds to the locations of the traffic stop.

“I’m going to stop a car,” the officer says on the recording. “I’m going to check IDs. I have reason to pull it over.”

“The two occupants just look like people that were involved in a robbery,” the officer says. “The driver looks more like one of our suspects, just ‘cause of the wide set nose,” the officer continues.

A minute and a half later, the recording captures the first report that there was a shooting.

There is no evidence the gun was in his lap. Castile INFORMED the cop that he had a concealed carry permit.

By all accounts he was a model citizen with NO criminal record.

The cop asked for his ID, and when he attempted to comply with the officer's request, he was fatally shot.

No. His girlfried SAID Castile informed the cop that he had a concealed carry permit. This is the same girlfriend who said they were pulled over because of a busted taillight.

Once again, the girlfriend SAID the cop asked for his ID. If the cop walked up to the car and saw the gun in Castile's lap, I doubt he would ask for an ID.

Philando Castile had a valid permit to carry a gun when he was shot and killed by a St. Anthony police officer, a source confirmed to the Star Tribune Friday.

Although the names of gun permit holders are not public under state law, a source confirmed Castile was issued the permit when he lived in Robbinsdale..

He was shot because he FAILED to comply with the officer's request not to reach for the gun.

He was complying with the cop's request for ID.

What's your source on this? Even the cop's lawyer is referring to "the presence of a gun" generally rather than its presence in Castile's lap.

A government strong enough to impose your standards is strong enough to ban them.

Matt Finn just reported for Fox9 News in Minnesota confirming some details and adding a few more after discussion with Yanez attorney and investigators:

Officer Jeronimo Yanez is Mexican not Asian as claimed by Diamond Reynolds.
Philando Castile and Diamond Reynolds did not comply with instructions to keep their hands “up, visible and don’t move them”.
There was a handgun “visible” on the lap of Philando Castile
Officer Yanez reacted to the gun and Philando Castile’s movements.
Confirmation again that officer Yanez did pull over Castile and Reynolds as an outcome of Castile fitting the profile from the armed robbery July 2nd.

Scenario number one.....I submit that the female person riding with him said these words "he has a gun....permit, he has a permit to have a gun". Right there, the cop hears only that the man has a gun. The guy is flagged because he fits a profile of a BOLO, for all the cop knows he is facing a guy with a kid and a woman in the car that don't know he is a bad man, or has them frightened to be with them. How hard is it to imagine the guy being pulled over, he puts his gun on his lap and tell the bitch to shut up?

I am not saying this is what happened, but it is possible this is what was on the cops mind. Thinking he has the bank robber, and the guy has his woman in the car, but he has a gun...what do you do? He either acted heroically or he panicked and blew it BIG TIME. So he errs on the side of going home to his life.

If we make it harder for the police to do their jobs by protecting them from prosecutions for mistakes, all we will have is the equivalent of the S African police of 2016, or the Federales of Mexico.

Exercising rights is only radical to two people, Tyrants and Slaves. Which are YOU? Our ignorance has driven us into slavery and we do not recognize it.
