Sexting

Dreamstime

Fayetteville, North Carolina, cops have charged 17-year-old Cormega Copening with sexual exploitation of a minor—his girlfriend, who is the same age—because the couple sent each other nude photos of themselves during their relationship.

There’s no evidence the photos were ever sent to anyone else, and police only became aware of them because they searched Copening’s phone for unrelated reasons that haven't been specified. Even so, the teen—formerly the starting quarterback at his high school—faces decades on the Sex Offender Registry and up to ten years behind bars if convicted. He’s also been benched from the team while Jack Britt High School investigates the matter.

Copening’s girlfriend—who remains unnamed in the news articles—is also facing charges, ABC11 reported.

These teen-sexting witch hunts are almost always outrageous; they conflate child pornography with something far less sinister. It’s perfectly normal—and wildly common—for kids to express an interest in sex. Should authority figures discourage underage sexting? Sure. Should they ruin kids’ lives for doing it anyway? Absolutely not.

But Copening’s situation is more outrageous than most. As far as I can tell, the pictures weren’t shared with anyone else—this isn’t a case where a boy texted a girl’s nude photos to all of his friends and caused her some considerable public humiliation. The photos were private, and remained that way, until the cops got hold of them. If there’s public humiliation here, police intervention is the cause.

Consider as well that Copening reciprocated with photos of his own. Does not a mutual, voluntary exchange of photos undercut the notion that “sexual exploitation” is a factor here? It’s more than a little ridiculous to accuse these two of exploiting each other—although this is precisely what the authorities are doing, I presume (the specific charges against the girlfriend were not reported).

Lastly, it bears repeating that these teens were 17. If they had waited until they were 18 to send the photos, no crime would have occurred. Eighteen-year-olds are recognized as fully-autonomous sexual adults. Kylie Jenner, who just turned 18, has been inundated with requests to make a sex tape (indeed, filmmakers began making these requests even before she turned 18). The law, by its very nature, permits no nuance: you are 18, or you’re not. But it’s ridiculous to think that teens are magically transformed into adults on their 18th birthday. Many of them—perhaps Copening and his girlfriend—might be ready for mature relationships that involve sex (or, at least, sexy pictures) prior to the government’s randomly-selected date.

There’s one more disturbing angle to this story. If Copening is too young to send pictures of his own body, is he not also too young to be made a social pariah? Don’t news agencies often withhold publication of the names of crime victims when they are underage? Copening is a crime victim, according to the police, but multiple local news agencies reported his name and the full situation. They reported on his suspension from the high school football team. They showed his headshot. They pointed out the likelihood that he will have to register as a sex offender.

The criminal charges and possible jail time are the worst consequences of the police investigation, but the smearing of Copening’s name and ruining of his high school experience are also unfortunate outcomes—each of them much worse than the harm from a nude photo swap that would have never come to light if the cops had minded their own business. Boo-freakin-HOO.

Sorry. You (and author Robbie Soave) lost me at "teen-sexting witch hunts."

And NO, teens who exchange texted graphic personal porno is NOT "perfectly normal" -- in as much as the freak whose opinion it is sez it is.

If they had waited until they were 18 to send the photos, no crime would have occurred.

Right. AND....that is the law.

Author Robbie Soave seems....OBSESSED:

This story is an anomaly...NOT what the obsessed author disingenuously portrays as "teen-sexting witch hunts" as though its epidemic.

What IS epidemic is the indictment of something VERY real -- a non-stop LE witch-hunt. THIS story is further evidence of that crusade.

"The photos were private, and remained that way, until the cops got hold of them. If there’s public humiliation here, police intervention is the cause."

So private photos of an underage child are legal as long as you keep them private?

Jared would disagree.

True. But think of it like drunk driving. You're arrested for what you might do.

First of all, "ruining a kid's life"?? Can you be any more a Drama Queen?

Secondly, he's a minor.

Thirdly, the "private" self porno-pix weren't so "innocuous," were they?

Fourthly, the cops are only enforcing a LAW that protects minors from predators. Even MINOR predators. Would you approve of this activity from you daughter or son?

Last but not least, your personal comment ("I guess that's not unexpected from you") is baloney. Your problem is an odd obsession with anarchy masquerading as freedom. Without laws we HAVE no real freedom.

The publicity of this throughout their school, along with the potential legal issues, will certainly be far more harmful to them then whatever direct consequences of the activities themselves.

And if the teen school population agrees that the legal repercussions are extreme and unjust, there may well be protesting and sympathies expressed in their favor creating an atmosphere of sexting as a form of protest from kids that otherwise might never do it.

Respect for the "law" will take a hit which is bad for society.

Of course many of the school's teens will do what they do at that age -- protest/rebel by sexting....and worse. It'll be so cool! "Hey LaQueesha -- here is a pic of my %#$@! Now you send ME a pic of your hot %$#@! We'll show those %$#@!s that WE'LL decide what %$#@! rules and laws we deem &%#@! fair!"

NOT a noble hill to die on.

If kids who ordinarily wouldn't do it WILL indeed DO it, it would say more about just how our perverse society regards any code of morality to begin with.

Neither of the two kids are predators.

Would you approve of this activity from you daughter or son?

I would not approve, but I would not want to see either of them prosecuted as sex offenders or jailed for ten years because of an arbitrary state-determined age distinction.

I can imagine you on the other hand wanting your child to experience the full force of the government - you know - to "teach them a lesson".

I shudder to think what you would do if you found out one of your kids was homosexual.

You don't get it yet, do you? The State is making even the most petty offenses into felonies - and you sit there and cheer the constant erosion of freedom and privacy.

Maybe you could make a case if the boy was 18.

Perhaps since you appear to support the surveillance state in matters that you find offensive, we should task the NSA with rooting out these evildoer teen boys and girls who send nude pictures to one another.

Maybe you can petition them yourself.

After all - it would just be more to add to your jihad.

When I was a teen, the only way one could send naked pics of oneself is to buy a camera and film, set it up with a timer and hope you had the focus correct, pose then pay some stranger to develop it, and then give the only copies away.

That's far, far, far more difficult, time consuming and costly than it is in today's digital age. I don't think it's fair to compare the actions of today's teens with any prior generation in history. They aren't the ones who invented cell phone cameras either.

Damn, Liberator. Lighten up here. When I was 12 peers my age were already talking about sex and some were even getting it on then. Stop acting like such a prude and get with reality. Kids and even teens today are more wiser than you would ever even imagine. And by the way, since when is it immoral for teens to be interested in sex? It's actually quite healthy and since parents don't teach their kids anymore about sex, expect the kiddies and teens to learn it elsewhere. That does not make them perverts or sex offenders unless one of them is over the age of 18 and engaging in sex with a minor. I believe those cops misrepresented the law as well as maligning the two teens community standing and reputation and I do believe those two teens have standing to sue the bitch out of those officers. Those unlawful search and seizure methods used were way beyond the pale and the punishment the cops want to enforce on these two minors does not fit the crime at all.

So there we have it; Unrelated reasons, unspecified reasons, and PURE speculation all around. Yet somehow the Po-Po are on this case. Sounds like a far more complicated issue than what's being sold here by the agenda-driven author as "innocuous," innocent private "sexting."

The starting QB -- apparently a prima donna who makes up his own rules -- is learning a lesson the hard way. It's pure dramatic hyperbole to assume our star QB will spend "decades on the Sex Offender Registry and up to ten years behind bars as a minor" under the circumstance WE are being told is the case.

Neither of the two kids are predators.

We "know" nothing of the sort.

I would not approve, but I would not want to see either of them prosecuted as sex offenders or jailed for ten years because of an arbitrary state-determined age distinction.

"Sex-Offender" based on...what again?? This sound like reeeealy bad BS. Btw -- the "arbitrary state-determined age distinction" -- would you prefer it to be 16 yo? 15? 12?? Don't like the law, CHANGE IT.(Oh wait -- it's pretty universal in the USA.) But when a 17 year old riots, rapes, murders, and pillages, according to "news reports" and attorneys," he's a "Juvenile" or a "child" to you, eh? ALL 6'-3", 200 lbs. of him. If that child" were assaulting you or your family, is he then an "adult"? OR a Child"?

I can imagine you on the other hand wanting your child to experience the full force of the government - you know - to "teach them a lesson".

I would expect the opinion of an Anarchist to be negligent in wanting to teach a damn thing -- including RESPECT -- to spoiled brats and punks who learn about life from MTV as they laugh at the law....but...learning lessons early on is doing EVERYONE a favor.

I shudder to think what you would do if you found out one of your kids was homosexual.

And THAT has what to do with this case? Or are you just trolling and crusading for more LBGT "intolerance"?

You don't get it yet, do you? The State is making even the most petty offenses into felonies - and you sit there and cheer the constant erosion of freedom and privacy.

Yeah, I DO get it; But you, 0blabla, Holder, and the SPLC/ACLU see "Ebil LE" lurking behind every shadow in a nation of 325 million people -- 40 mil of whom are illegal invaders, another demo having declared war on Whitey, and yet another demo has declared war on the Constitution, God, the Family and heterosexuals. Your obsession and degree of propaganda is Goebbelian. This nation is at the throes of Anarchy, respect of and for the Law is eroding, and here all you can do is post examples of "intolerance" for LBGT, the Religion of Pot, and a tiny minority of rogue LE abusing their authority -- something that has ALWAYS existed, but according to the Anarchists, it's "epidemic." I say BS to that. and your agenda. Narcissistic anarchist A-holes and punks need their azzes kicked every day by LE because THEY and their incessant whining and challenging the law are making MY quality of life worse by wasting society's assets, money and time in courts (thanks to liberal attorneys and misguided crusaders like YOU.)

Perhaps since you appear to support the surveillance state in matters that you find offensive, we should task the NSA with rooting out these evildoer teen boys and girls who send nude pictures to one another.

Are you doin' a doobie RIGHT NOW?!? Lol

Maybe you can petition them yourself. After all - it would just be more to add to your jihad.

There’s no evidence the photos were ever sent to anyone else, and police only became aware of them because they searched Copening’s phone for unrelated reasons that haven't been specified.

On its own the charge seems stupid. However, they searched the guy's phone for some reason and evidently found something. Without knowing what else they found, it is difficult to assess the merit of this action.

As speculation, he may have a collection of such girlfriend photos, going back a few years. This girlfriend may have become a cooperative witness.

The rest of the story is needed before this is dismissed as an overreach. It could just be two teens, or it could be one teen quarterback football hero who has done this with lots of underage girls.

http://myfox8.com/2015/09/01/nc-high-school-quarterback-facing-sexting-charge/

The charges stem from an incident that happened last October. The couple was charged in February, but Jack Britt High School officials said they were unaware of the charges until a couple of weeks ago.

http://wncn.com/2015/08/31/jack-britt-high-school-qb-facing-sex-charges/

Copening is charged with five counts of sexual exploitation of a minor. Officials said the incidents happened while he was a student at Douglas Byrd High.

During an investigation in October of last year, deputies say they found nude pictures in Copening’s cellphone and that he and his girlfriend were apparently sexting. Both are under 18.

Copening is also charged with breaking a student’s car window with a football.

http://www.fayobserver.com/news/local/nc-law-teens-who-take-nude-selfie-photos-face-adult/article_ce750e51-d9ae-54ac-8141-8bc29571697a.html

The Fayetteville girl, Brianna Denson, was sexting with her boyfriend, Cormega Zyon Copening, the Sheriff's Office said. The agency hit Copening with five sexual exploitation of a minor charges - four for making and possessing two sexually explicit pictures of himself and the last for possessing a copy of the picture that Denson made for him.

Copening, who was 16 at the time and is now 17, also faces possible prison time and the requirement to register as a sex offender if convicted. The charges have already forced him off the football team at Jack Britt High School. He had been the quarterback.

[...]

The investigations usually are into instances in which photos are shared among a group instead of just within a couple, he said. To his knowledge, Denson's and Copening's pictures weren't shared with anyone else. He said they were discovered during an investigation of other explicit photos that were being shared among teens without the consent of the person or persons pictured.

West would not comment on the specifics of the Denson and Copening cases. However, he said, in cases where the defendants and victims were willing participants and close in age, his office typically lets them plead guilty to a misdemeanor with a deferred prosecution.

This is how Denson is settling her case.

In court on July 21, Denson told District Court Judge Stephen Stokes that she was responsible for the crime of disseminating harmful material to minors. This is a misdemeanor and does not have the life-ruining requirement that she register as a sex offender.

One of West's assistants dropped the felony sexual exploitation charges. Stokes put Denson on probation for a year. He ordered her to pay $200 in court costs, stay in school, take a class on how to make good decisions, refrain from using illegal drugs or alcohol, not possess a cellular phone for the duration of her probation and to do 30 hours of community service.

If Denson stays out of trouble, West's office next July will drop the misdemeanor charge. She will be able to move on with her life with a clean criminal record.

Those unlawful search and seizure methods used were way beyond the pale and the punishment the cops want to enforce on these two minors does not fit the crime at all.

You know NOTHING of this case, nor of the extent or circumstances other than what you are fed and swallowed whole. Reactionary COPS = BAD. Like a good little brainwashed pod. Yet you assume and pretend to be some kind of character you're an eyewitness? HA!

FAIL.

Only in your perverted mind.

An entire 5 word sentence. Your usual elequence...and you hardly even used any crayon! But I see you're...getting aroused, eh Gramps? Maybe War can hose you down.

Hey -- aren't you the liberal pod who has been an advocate of tranny-society? Gay Marriage? Homofascism? And voting for Sanders or Hitlety? Yup. That's you, Ethel. Nice closet you got there.

Thanks for your investigative work, Chan...

It's soooo much easier to just blame..."COPS!"

The agency hit Copening with five sexual exploitation of a minor charges - four for making and possessing two sexually explicit pictures of himself and the last for possessing a copy of the picture that Denson made for him.

West would not comment on the specifics of the Denson and Copening cases. However, he said, in cases where the defendants and victims were willing participants and close in age, his office typically lets them plead guilty to a misdemeanor with a deferred prosecution.

This is how Denson is settling her case.

The starting QB -- apparently a prima donna who makes up his own rules

I get it now.

You were jealous of all the other boys who made the team and you didn't.

So sorry.

I would expect the opinion of an Anarchist to be negligent in wanting to teach a damn thing -- including RESPECT -- to spoiled brats and punks who learn about life from MTV as they laugh at the law....but...learning lessons early on is doing EVERYONE a favor.

Man, get a frigging grip here.

You make it sound like the kids killed someone.

But you, 0blabla, Holder, and the SPLC/ACLU see "Ebil LE" lurking behind every shadow in a nation of 325 million people -- 40 mil of whom are illegal invaders, another demo having declared war on Whitey, and yet another demo has declared war on the Constitution, God, the Family and heterosexuals.

Your descent into utter insanity is complete.

I wish you all the best.

True, I may no not more than what is given to this story but my concern is not the 17 year old QB with sex photos of his 17 y.o. gf but the fact that the cops have it as well. That's what is so creepy. Cops having those photos of two underaged teens. Since when does it become an issue for cops to meddle in with two teenagers sexting habits? What is the actual statute for charging someone with statutory rape with a minor in that State?

You refer to those like myself as hipsters? Yep, I'm proud to be one.

I never said that sex at 12 y.o. is normal but I can tell you that kids are doing it and that is a reality. It is you that really needs to wake up and face reality.

Anarchists? Not even close but I certainly do question authority figures who believe they are above the law. And I will even sue as well. I don't have a pussy mentality and I don't need a purple heart or patch depicting me as some soldier hero. I was born a warrior.

There’s no evidence the photos were ever sent to anyone else

Doesn't matter. The cat's out of the bag already.

I don't think the young man should be charged nor for LE to be involved. I think the justice the young man should face is the young woman's father.

Lastly, it bears repeating that these teens were 17. If they had waited until they were 18 to send the photos, no crime would have occurred.

But they didn't. I'm sure pederasts and rapists use the same arguments in court.

Again, back in the day if something like this happened, the young man's father and the girl's father would handle the situation.

The level of potential punishment is extremely disproportionate.

Perhaps. But back in the day the father of the son and the father of the daughter could go to war over such happenings. Hatfields and McCoys etc.

But a more reasoned approach is for the father of the daughter to work the matter with the father of the son. However, given the family unit today you cannot be assured either has a father that is present or cares.

The moral of the story is to not expose your body to someone who is not your husband/wife.

So private photos of an underage child are legal as long as you keep them private?

Jared would disagree.

That's a good point. I'm sure pedophiles and pederasts have used the very same defense and still do.

Even so, the teen—formerly the starting quarterback at his high school—faces decades on the Sex Offender Registry and up to ten years behind bars if convicted. He’s also been benched from the team while Jack Britt High School investigates the matter.

Actually, the above might help him get into U PENN and drafted by the Dallas Cowboys.

Neither of the two kids are predators.

Not enough information to determine such. Only this one sided article in support for the teens involved.

Teens can be just as wicked and abusive to their peers as adults...probably worse. These High Schools have become microcosms of vanity, cruelty and exploitation. One only has to flip the channels and see the programming for ABC 'Family' and Disney and a host of others. Media and corporations are 'meeting' the demands of these teenaged oversexed cretans. The kids who just want to go to school, learn, get good grades and play some sports or do some activities are bombarded daily with the oversexed culture in public schools. And some of the teachers encourage it.

Do you have a daughter about the same age as this girl or at one time did?

If so what was your home policy if you found the nude photos?
