Title: Cop Unleashes a Flurry of Bullets at Car Full of Teens Who Accidentally Knocked on His Door

A car full of teenagers had just left a party and were dropping off a friend when they accidentally knocked at the door of the wrong home. They meant to go to the house next door, and this honest mistake nearly cost them their lives, thanks to one of New Jersey’s finest.

An off-duty New Jersey state trooper fired shots at their car as it drove away from his home early Sunday morning.

According to the AP,

Jesse Barkhorn, 18, who was in the car that night, told The Associated Press on Wednesday that they attended a party earlier and were dropping off one of them at a friend’s house in North Jersey. He said they mistakenly knocked on the door at the house next to their friend’s house. He said they heard a man screaming from inside and they ran back to the car.

They turned around in the cul-de-sac where the home is located and saw the man standing with his weapon pointed at them, Barkhorn said.

“At this point we’re freaking out, ‘It’s a gun. It’s a gun,’” Barkhorn said. “I was like ‘Dude, get out of here.’”

The teenagers then drove off.

Despite posing no threat to the officer and attempting to leave, the trooper fired multiple rounds at the car full of teens. Luckily none of the occupants were hit. However, a bullet took out the car’s front tire and they car stopped a short distance down the road.

According to their report, the police describe the same story. Two 18-year-olds and a 19-year-old went to the wrong house, knocked on the door and fled after a verbal exchange. They got into their car and drove away as the trooper fired three shots with his personal weapon when the car did not stop, officials said.

One of the teens, who was scared for his life after being shot at, took off running after the car was stopped. However, hours later, all three teens would be taken to jail for being shot at by a cop.

After nine hours of interrogation, the boys were all released with no charges.

“It was traumatic. I really have never been in a situation like that,” Barkhorn said. “You don’t really appreciate things until you have a gun pointed at your head. It was really scary.”

The trooper who unjustifiably fired his weapon nearly killing three teenagers was not taken into custody, however. He was not charged, and he remains on active duty.

Defending your home from intruders is, without a doubt, an inalienable right. Most people, when hearing a knock on their door late at night would get defensive, and some would grab a gun. This is a normal reaction.

However, shooting at a car as it flees and poses no threat, is nothing short of attempted murder.

You can rest assured that these young men did absolute nothing wrong, as police, in an attempt to justify their fellow officer’s actions, likely gave them the interrogation of a lifetime. They made an honest mistake by knocking on the wrong door, and for this, a public servant attempted to kill them.

If this officer conducts himself in such a manner while he’s off duty, then he poses a significant threat to the public when he’s on duty.

Sadly, shooting at fleeing cars and killing people happens all too often during police stops. On Wednesday, University of Cincinnati Police Officer Ray Tensing was indicted for the murder of Samuel Dubose. Dubose was killed as he attempted to drive off, and Tensing shot him in the head through the driver’s side window. He was never in danger.

On Thursday, the Free Thought Project reported on the story of Zachary Hammond, 19, who was shot to death through an open side window by a police officer attempting to kidnap him for possessing a plant.

Shooting at fleeing individuals is the conduct of tyrants. It is the work of cowards and the antithesis of a heroism.

Criminals always flee. It's what they do.

Just because they're fleeing is not a reason not to shoot them. What if the perp is intent on committing a murder elsewhere?

A cop has a right (and a duty) to shoot at serious criminals attempting to flee.

Generally, that does not apply to cops shooting at routine traffic stops for plate or inspection violations (Ray Tensing case) or these kids knocking on the wrong door at night.

It was between 1:30 a.m. and 2 a.m., Saturday night, Sunday morning. The trooper allegedly believed they were trying to enter his house and, after the verbal exchange through the door, he allegedly identified himself as a cop, and pursued them when they fled. They drove into a cul-de-sac and turned around. The trooper entered the street to stop them. They accelerated toward him and he fired three shots, taking out a front tire, disabling the vehicle.

It's Free Thoight Project... It's what they do. Spin it.

However, even given your non YELLA account, IMHO, the officers actions were reckless. He shouldn't use DPF unless it's self defense in this case.

Having read that version, the shooting was not justified, and the teens were well within their rights to flee, as they had no reasonable cause to believe the armed man was a cop.

Just because an armed man claims to be a cop does not mean he is. Presumably he was not in uniform, if he was disturbed from his sleep.

Walking onto a street, armed, to stand off with another who is operating a car... this is a case of both persons being capable of killing the other. Why would one be allowed to do so, and not the other? Meaning, if in a similar situation, the cop was in the car and a non-cop was armed with a gun, would the cop not be justified in running down the armed man out of fear for his life?

Equal right of self defense must apply to both parties. This cop attempted to use deadly force against the kids, and there is no evidence the kids did the same, or were attempted to do the same. By entering the street and attempting to stop a car leaving the scene, the cop needlessly placed himself in danger.

Just because an armed man claims to be a cop does not mean he is. Presumably he was not in uniform, if he was disturbed from his sleep.

Even male strippers can have a cop uniform laying around.

I think a badge has to be presented credibly. If a traffic stop is made, it has to be by a lawful patrol vehicle.

The story doesn't indicate if this cop was in a uniform (or waving his badge in a dark street at night in the direction of three scared teens trying to drive away fast).

So there is an underlying question of whether the cop was warranted in shooting if he was not presenting himself as a lawful (off-duty) police officer.

The real question here is whether any non-police homeowner would get away with shooting at a car of fleeing young men (who had committed no crime), including shooting out a tire.

It would be interesting if some local reporter dug out some local history from the police blotters (or Lexus-Nexus news database or one of the online legal databases) to indicate how similar shooting incidents in residential neighborhoods in that city (and/or state) were handled and either prosecuted or dismissed.

There could be more to this story in other respects. Was it a peaceful suburban neighborhood or was it a gentrifying area near a slum area with a high crime rate? A cop will naturally get more leeway if he lives in or near a high-crime area.

Also, does the cop have a history that might make him a target of criminals, like arresting/testifying against a major drug lord or something similar that might make him a target for retaliation.

As with so many of LF's True Crime and Cops stories, there is at least as much that we don't know from these articles as what we do know factually. There is always more context to these stories.

Quite often, when we discuss these stories, we build a mental picture in our minds based on our own history and perceptions and then we proceed to argue over these as though we all actually imagine the circumstances in these cases to be as simple as these light-on-facts articles to be the same. But it is almost certain that we each have significant differences in our underlying impression of an article, based on our individual differences.

Of course, that is what makes these True Crime threads such a clickbait honeypot.

Agreed. However, it may form a defense against a potential charge of attempted homicide if he was shooting at the tire.

The cop, at close range, hit a tire. He might have hit the car proper if he was aiming at it. It may be reckless without being attempted homicide.

Shooting at car tires should be looked at as deadly physical force. Such a reckless action could easily produce an accident that causes death. Every department I've had the privilege to read their policy and procedures, has strictly prohibited such an action.

I would bet they also take a dim view of civilians shooting out tires too.

Since we don't know if the cop presented himself lawfully as a police officer (uniform/badge), he can't be presumed to have any greater right to use violence than an ordinary civilian would (barring his being forced to take action to stop a murder being committed or similarly gross criminal action).

Without the badge and uniform, this cop was just another guy shooting out someone's tire and firing at their car at night in a suburban neighborhood. Just imagine what the police and prosecutors would do to any non-police that pulled such a stunt.

I agree, but it may reduce the charge from attempted homicide to one of reckless endangerment. From a defense viewpoint, I think it would be better to be found to have aimed at the tire and hit it, than to have aimed at someone's head and missed. I'm not saying either is right or justified.
