He is 100% right... but IMHO, he handled it wrong (if he has any hopes of being the next POTUS)

His answer for any question regarding queer rights is this... Those issues have nothing to do with me or the presidency. The constitution leaves decisions about gay marriage up the each state. I'm bound to uphold the constitution. I have no opinion on an issue I don't have the authority to decide over.

Repeat that every time asked. Period.

The U.S. Constitution does not extend rights to the states (or individuals). The U.S. Constitution lists the powers the states have ceded to the federal government -- all other powers are retained by the states.

States have always had the power to define marriage. That power was not ceded to the federal government.

B) It reads, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

C) The 10th amendment says nothing about rights.

I'm a big believer in the 10th amendment. But the 14th amendment -- which has been used by the courts to apply federal laws to the states -- has done far more damage to the intent of the 10th amendment than any commerce clause interpretation.
