Seattle, WA —  A 70-year-old retired Air Force veteran was abused and arrested for absolutely no reason at all.

William Wingate, a man with no criminal record, was walking down the street, as he does every day, using a golf club, which he has re-purposed in to a cane. He’s been using this cane/golf club for 20 years.

On July 9, 2014, however, his daily walk would cross paths with overzealous Seattle Police officer, Cynthia Whitlach. Completely out of the blue, at 1:00 in the afternoon, Whitlach pulls up to Wingate and demands he drop his cane.

Wingate, obviously surprised and confused as to what was going on, tries to figure out exactly what it is Whitlach wants.

“Drop the golf club!” screams the officer, seemingly jacked up on her authority.

“What? this is my golf club,” says Wingate having absolutely no idea why Whitlach is demanding he drop it.

“You just swung that golf club at me,” Whitlach yells.

“No, I did not!” exclaims Wingate.

“Right back there,” Whitlach says back. “It was on audio and video tape.”

The fact that Wingate never swung the golf club at Whitlach and no video was ever produced showing this, did not stop this tyrant from kidnapping and caging this innocent man.

The Stranger Reports:

On the video, Officer Whitlach can be heard insisting that the recording would show Wingate swinging his golf club at her and hitting a stop sign with it. According to the SPD, there exists no video to back up this claim. (SPD did not make Whitlach available for comment.)

“The allegation that he swung at the police car,” said city council member Bruce Harrell, who subsequently got involved in the case, “wasn’t corroborated by any other facts and was not caught on any video. What was caught on video was him minding his own business with the golf club at his side.”

Eventually Whitlach tells Wingate that he’s going to be arrested and Wingate complied. Had he not complied, an innocent 70-year-old black man could have died in Capitol Hill that day.

A few moments later, officer Chris Coles arrives, calls him “sir,” and he hands over the cane. The heart wrenching video continues as this poor man is loaded into the back of the paddy wagon.

“The system failed this man. He never should have been stopped. Once he got to the precinct, reason should have prevailed,” said Washington State Rep, Dawn Mason.

But reason did not prevail.

Wingate was subsequently booked into King County Jail on harassment and obstruction charges. He was held there over night.

The video of this incident is saddening and deplorable. To watch an innocent man, minding his own business while out for a walk on a beautiful day, be deprived of his freedom by a cop on a power trip, is disheartening, to say the least.

After backlash from the community and lawmakers, SPD Chief Carmen Best issued an apology to Wingate…… 8 months later. 

As for Whitlach, she still combs the streets looking for innocent old black men to abuse. She received not one day of suspension for depriving an innocent man of his rights, and only had to undergo counseling from her supervisor; a course of action that the “department believes to be an appropriate resolution.”

For the first time, you have presented us with a video that shows from the beginning to the end. Thank you for this. Most are censored to show and depict only what the author wishes us to see.

I watched video and listen to the audio carefully and I could see no reason Officer Cynthia Whitlach stopped to address William Wingate. Unless there is part of the conversation I did not hear or something I did not see, William Wingate did not swing the golf club at her.

On this basis, I can only conclude that Whitlach was wrong to make the stop and she lied about Wingate swinging the golf club at her.

However, Wingate exacerbated the situation and contributed greatly to the problem.

Whitlach instructed Wingate to put the golf club down. She had every right to issue that order because she had stopped her car and she was therefore obviously going to approach him. She had every right to tell Wingate to put the golf club down the same right she would have if he had been holding a gun.

You must follow all lawful directions of the police officer. If the police officer is wrong, then get remedy through court action and file for monetary damages if applicable.

This all could possibly have been over in a couple of minutes, had Wingate followed her instructions. He showed indiscretion in not following the instructions. Perhaps senility contributed to this, and she should have taken that into consideration.

My call on this would be two wrongs equals no right and she committed the first wrong by stopping him for apparently only carrying a gold club.

If an investigation confirmed my apparent conclusion and she had had a good record, I would recommend intensive retraining. However, if the investigation showed a pattern of this type thing, then I would fire her.

Deckard, This is not something for me to think about even for one moment, . First of all, I do not golf and therefore I have no golf club to carry about. Secondly, if I were in this situation, I would put the gold club down immediately….and then engage in a discussion with her.

How do you see this, GrandIsland….you are the only one qualified to give a correct critique here.

Supposedly he made some sort of gesture (pointed to a STOP sign with his cane) earlier and then she went around the block to confront him.

But the alleged gesture isn't on the video, and I'm not sure I see her driving around the block on the earlier segments of the tape either. She waits through a red light before making her last turn and doesn't appear to be in much of a hurry.

I've been advocating the use of body and dash cams for a long time and I'm glad the technology is now readily and cheaply available to make it happen. The more all sides are held accountable by the Truth, the better off we'll all be.

Do a google search of "Cynthia Whitlach". Her facebook comments lead me to wonder whether, had this elderly gentleman had been white, she wouldn't have given him and his golf club a second glance.

Either way, the Ferguson agitators achieved a victory.

SEATTLE —

Seattle Police Department Chief Kathleen O’Toole has ordered a review into the conduct of Officer Cynthia Whitlatch, who the department confirmed posted questionable comments on Facebook and arrested an elderly veteran who was using his golf club as a cane.

The video of that arrest was released Wednesday, although the actual arrest occurred in July.

"You swung that golf club at me when I turned the corner at 11th and Pike,” Whitlatch said to him.

But the 20-minute dashcam clip doesn't show Wingate swinging the club at Whitlatch. The video starts with Whitlatch yelling at Wingate for at least three minutes to put down his golf club.

"You just swung that golf club at me!” Whitlatch said in the video.

“I didn't swing no golf club,” Wingate responded.

Wingate was arrested and booked into jail. He does not have a criminal history.

“I was scared,” Wingate said. “I didn’t know what was going to happen to me. I knew one thing—I was being framed.”

KIRO 7 confirmed Whitlatch also posted comments on Facebook responding to a post about riots in Ferguson.

She called it “chronic black racism” and said, “I am tired of black peoples [sic] paranoia that white people are out to get them."

When Facebook user Brian Davis reacted, she calls him “another black racist.”

KIRO 7 asked Wingate if he believes his arrest was racial profiling.

“I don’t know,” he said. “I know one thing. I’m a black man walking down the street doing nothing and I got stopped and went to jail by a white police officer.”

Whitlatch is also one of the officers who filed a federal lawsuit against the city's use of force policies.

Despite SPD apologizing for his arrest and the charges being dismissed, Wingate said he fears police and will not return to the same block.

“They could do something else to me,” he said.

Council member Bruce Harrell said there's no reason why Wingate should have been arrested in the first place.

"He's an outstanding gentleman, so it seems a little bizarre that such a reasonable person with no criminal history would swing wildly a club at an officer," Harrell said. "That doesn’t make common sense.”

Seattle police said Whitlatch is a veteran officer and has not had any previous disciplinary issues.

"The officer who made the arrest received counseling from her supervisor, a course of action that the department believes to be an appropriate resolution," the SPD said in a statement.

SPD said a complaint has been filed with the Office of Professional Accountability over the incident.

However, Wingate filed a claim with the City of Seattle. He's asking for damages of more than $750,000.

His claim says, in part: "Mr. Wingate's physicians and family members and friend will attest to the emotional distress caused by the racial profiling, arrest, and incarceration of this man, whose only crime was 'walking in Seattle while black.'"

SPD said there was no racial bias in the incident.

Spokesperson Sgt. Sean Whitcomb said the department could have handled the incident with Wingate much better.

“He should feel confident walking with a golf club in hand anywhere near the East Precinct,” Whitcomb said. “He should absolutely not be concerned.”

He said the chief’s review will reveal whether Whitlatch has improved her behavior or whether there have been more red flags.

KIRO 7 reached out to the Seattle Police Officers’ Guild but did not hear back.

The worst thing about this tape is the way no one comes to his aid or even stops long enough to be a witness.

But veterans need to be aware of the FACT that the police, by order of the DOJ want all vets to have either a record or a medical report on file showing them to be unstable, so as to preclude them from being armed.

On the video, the officer said what sounded like, "...you swung the golf club at me at 11 and Pike". Swinging it redefines it as a deadly weapon.

The allegation was that he previously swung the cane at her car minutes before she allegedly relocated him. If that's on video, I haven't seen it. If that's true, she was within her right to disarm him and interview him as to his intentions with a golf club.

I noticed she wasn't fired or terminated... but punished long after for making alleged racial comments on FB.

Also, the charges were dropped, that were filed from the video incident. That could mean two things. There wasn't any video to support her claims... or there was enough community sympathy for this man (he was well respected with no prior criminal record).. and the DA decided to squash the charges for political reasons.

It should also be noted that this officer was a veteran without any history of discipline problems.

I'll suggest, based on the limited info any of us has, she looks at black people like Deckard looks at cops... and neither will ever act reasonable.

It's possible he swung it when the patrol car was even with him. But the cop thought it was on tape and would confirm her story. No need to make it up.

But, more importantly, what in the hell did we do before there was video? Seems to me that the attitude nowadays is, "if it's not on tape that means it didn't happen".

I would be more concerned about this story if it didn't involve a combative old man with a golf club. Not even the po-lice are going to tell him what to do. Just a matter of time before he swings that club at someone else who pisses him off.

Of course it is.

It's a slippery slope for police admin to no agree with an officers DIRECT OBSERVATIONS, when making arrests that don't invvolve civilian witnesses or victims. This is why I'm sure she wasn't fired. It has nothing to do with hiding corruption. Only this gentleman with the golf club and the officer knows what actually happened.

If administrations routinely don't believe their officers, no officer will make a direct knowledge arrest.

Who really knows what happened. Not I... and not Deckard. We all have our opinions.

If she lied... She should be hung up by her thong. If not, charge the angry man.

The video of this incident is saddening and deplorable. To watch an innocent man, minding his own business while out for a walk on a beautiful day, be deprived of his freedom by a cop on a power trip, is disheartening, to say the least.

Was This Racist Post Written by the Cop Who Arrested an Elderly Man for “Walking in Seattle While Black”?

Today, after reading this story about Seattle police officer Cynthia Whitlatch’s interaction with an elderly black man—in which she yelled at him to drop his golf club, which he was using as a cane, and then arrested him—Seattle resident Brian Davis sent me a message. Davis is black, and says he had an exchange with Whitlatch last August that concerned him so much he filed a complaint with Seattle’s Office of Professional Accountability.

In August, Ferguson, Missouri was in the midst of a series of explosive protests over the police killing of unarmed black teenager Michael Brown. I wrote about inflammatory Facebook posts from SPD officer Christopher Hall during that time right here.

Davis, via e-mail, explained that he’s friendly with another Seattle police officer named Dorian Oreiro. He sent me the above and following screenshots, which show his reaction to a post he says is from Oreiro’s account, and his exchange in the comment section with someone posting under the name Cynthia Whitlatch.

Facebook user Cynthia Whitlatch accuses Davis of being a “black racist” and writes, “If you believe that blacks are NOT accusing white America for their problems then you are missing the point of the riots in Ferguson and the chronic black racism that far exceeds any white racism in this country. I am tired of black peoples paranoia that white people are out to get them. I am tired of hearing a black racist tell me the only reason they are being contacted is because they are black solely because I am NOT black.”

Davis calls this Cynthia Whitlatch’s “Ferguson screed.”

“I’d never heard of her [Whitlatch] until I read her response to me on Facebook,” Davis told me in an e-mail message. “When she started talking about Public Records requests, I put two and two together and guessed she was an Officer, as well… I went to her Facebook page and there were other clues but it was a Google search that confirmed my suspicions that she was SPD.”

The screenshots from his phone are all he has, he said, because after he filed a complaint with the OPA he was de-friended by Oriero.

“I think what she wrote revealed a dangerous racial bias (especially coming from an Officer on a police force that is being monitored by the DOJ),” Davis explained. “And was problematic in almost too many ways to count… I just kept thinking she has already made up her mind about black people, especially black men, and carries that into every interaction she has with us.” He added: “She clearly didn’t know when she made the dig about gays suffering more prejudice than black men, that I am also gay myself. Never entered her mind that I could be both black and gay.”

“I did file a complaint with OPA [Office of Professional Accountability] and was told that she had a talk with her Supervisor,” Davis added. “That’s it.”

There was no OPA complaint filed regarding the incident on the street with Wingate last July, according to SPD. But the end result was the same: “Basically, she was talked to by her supervisor,” said SPD spokesman Sean Whitcomb.

Also, on what appears to be Whitlatch’s Facebook page, a user under the name Cynthia Whitlatch—who belongs to a group of what appear to be SPD members—”liked” an article from Guns.com about Arizona’s notorious Joe Arpaio purchasing AR-15 rifles for his sheriff’s department. The same user also shared a right-wing blog post titled, “The Trayvon Martin Picture the Mainstream Media Doesn’t Want You To See” and added the caption, “He’s huge…”

I’ve sent messages to Cynthia Whitlatch’s apparent Facebook page, the OPA, and to SPD asking whether this is, indeed, SPD Officer Cynthia Whitlatch. I’ve also asked for a copy of the complaint Davis filed with the OPA. A SPD spokesperson told me they are looking up the OPA complaint.

•Cynthia Whitlatch is one of 123 Seattle police officers who sued to block the department’s new federally-mandated use of force policies.

When Officer Chris Coles arrives on the scene, he approaches Wingate and addresses him as “sir,” and Wingate promptly hands over the golf club. Wingate has no criminal record.

But the officers went on to handcuff him. Police walked him down the street to the East Precinct, where Sergeant Joe Lam approved of the decision to book Wingate into jail on harassment and obstruction charges.

While still handcuffed, Wingate had difficulty stepping up and into the back of the paddywagon. On video, an officer can be seen sliding a stool toward the back of the vehicle, using his foot.

Wingate spent the night in King County Jail.

That moment from the video, when Wingate had trouble getting into the paddywagon on his own, said former Democratic Washington State representative Dawn Mason, “was awful. That one touched my soul.” She took an interest in the case after a neighbor told her what happened.

“The man is 69 years old,” she said, speaking with me on Tuesday by phone.“Seventy years of beating the odds of never having been arrested—a black man. Served in the military for 20 years. Worked with the police, because you do that as a bus driver.” (Wingate turned 70 in September of last year.)

“And here he is standing on the corner,” she continued. “He ends up handcuffed and put in a police wagon and put in jail overnight… The system failed this man. He never should have been stopped. Once he got to the precinct, reason should have prevailed.”
