To provide for a reduction in the amount that may be awarded to a unit of local government under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.) for a unit of local government that funds an amount that is greater than 18 percent of its operating budget using revenue generated from collecting fines and other fees related to violations of traffic laws, and for other purposes.

IN THE HOUSE OF REPRESENTATIVES

Ms. JACKSON LEE introduced the following bill; which was referred to the Committee on the Judiciary

A BILL

To provide for a reduction in the amount that may be awarded to a unit of local government under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.) for a unit of local government that funds an amount that is greater than 18 percent of its operating budget using revenue generated from collecting fines and other fees related to violations of traffic laws, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the 'The Urban and Municipal Justice Act of 2014' or the 'Justice Act'.

SEC. 2. FINDINGS.

Congress finds the following:

(1) The growing trend of local units of government using traffic fines and traffic court fees and costs as revenue generators promotes unfair, excessive targeting of citizens by law enforcement agents, infringes on civil liberties, and promotes reliance on unpredictable revenue sources.

(2) The growing trend of local units of government using traffic fines and traffic court fees and costs as revenue generators has the potential to breed public cynicism and distrust of local law enforcement agencies, and to lessen public confidence that the laws are being enforced impartially and the criminal justice system is administered equally.

SEC. 3. REDUCTION IN GRANT FUNDING FOR UNITS OF LOCAL GOVERNMENT.

(a) Collection of Fines for Violations of Traffic Laws- Except as provided in subsection (b), a unit of local government which, during the previous 3 fiscal years, funded an amount that, on average, was greater than 18 percent of its operating budget using revenue generated from collecting fines and other fees related to violations of traffic laws, shall, in the case of a unit of local government receiving grant funds under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.), receive only 25 percent of the grant award that would have otherwise been awarded to that unit of local government under such subpart.

(b) Disproportionate Racial Composition of Law Enforcement Agencies- In the case of a unit of local government described in subsection (a) for which, during the previous fiscal year, the percentage of individuals who identify as a race who were employees of the law enforcement agency for that unit of local government, and the percentage of individuals who identify as that race who live in the jurisdiction which that law enforcement agency serves, differs by greater than 30 percent, the unit of local government shall receive only 5 percent of the grant award that would have otherwise been awarded to that unit of local government under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.).

(c) Obligation of States- A State that receives a grant award under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.), which does not reduce a subgrant award made under such grant to a unit of local government in its jurisdiction in accordance with this section, shall, in the succeeding fiscal year, receive only 50 percent of the grant award that would have otherwise been awarded to that State under such subpart.

(d) Reallocation- Any funds withheld from a State or unit of local government from a direct grant award by the Attorney General shall be reallocated in accordance with subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.).

You knew it was only a matter of time before some legislation like this would rear its ugly head.

Let me guess, if this passes there will be follow up legislation saying the victims of those tickets (if they are a minority) will not have to pay those tickets! (The gravy train just keeps getting bigger......)

I have two outstanding traffic tickets. They allege I ran a red light.

I haven't paid them. I wont pay them.

I called the Police (They think they are judges now) told them they are illegal and I wasn't going to pay.

I called the scammers who run the cameras. They think they are police. I told them they can suck my dog off. I'm not paying.

My friend got ticketed in the DC area last year by some camera while he was visiting his son in college. His method of protest was sending in 15 checks in dubious amounts such as $9.18 and mailed them in five separate envelopes. They all added up to the $85 (I think) fine. It was one of those red light cameras.

Did you hear Ohio is thinking about passing legislation about those red light cameras?

From what I understand it says if there isn't a cop sitting at that camera when it takes a picture of you then the ticket is null and void. Now as you can see it doesn't sound like very good legislation but who knows how it might play out.

Ohio never seems like it does anything in a hurry, they phase in things over a period of time. (Take CCW laws for instance).

There should be a cop watching. How else can you have an accuser and be able to cross examine your accuser.

I would like to see all the cameras go. Maybe some outlaw could get their cordless saws all out and saw them all down.

Lockheed-Martin runs a lot of red light cameras. They were convicted of felonies back in the 70's for bribery, in Japan and Europe. Corporations like to be treated as actual people under the law, if Lockheed-Martin runs the red light cameras in your town then it is your word against that of a convicted felon, convicted on multiple felonies.

I ran across this while researching. Just curious as to how this now stands?

I see a number of places on the Internet that suggests ways to beat them if you do have to go to court...maybe you want to check those out.
