Washington D.C. to Appeal Right to Protect Its Citizens with a Ban on Handguns to Supreme Court

After a panel of three D.C. federal judges overturned the Washington D.C. ban on handgun ownership, there was uncertainty as to whether or not the city would appeal to the Supreme Court.

On July 16th, city of Washington ended speculation by announcing that it would indeed appeal the adverse ruling:

"The DC government will appeal to the Supreme Court to defend its 30-year-old ban on most handguns. Mayor Adrian Fenty’s office says the city's ban on most handguns can and should be defended.

"Washington's gun law bars residents from keeping handguns in their homes and carrying a gun without a license. Registered firearms must be kept unloaded and disassembled.

"In March, a three-judge panel of the U.S. Court of Appeals sided with six district residents who sued to be able to keep their guns for self defense. The decision repealed much of the city's handgun ban, but the ban stays in place through the appeals process.";

Over the last few years, the gun lobby has financed a "legal scholarship" campaign to reverse the long-standing legal precedent that the Second Amendment applies to the militia and not to individuals. The fruits of the gun lobby's efforts at Constitutional revisionism have paid off, particularly at a time when the federal courts are packed with right wing judges appointed during the Reagan, Bush I and Bush II presidencies.

Given a partisan 5-4 majority on the Supreme Court (Judge Alito has even indicated that he thought machine gun ownership is Constitutionally sanctioned in relation to the Commerce Clause - a real stretch), it will be interesting to see whether the so-called "conservative" judges side with legal precedent or the NRA.

According to the Violence Policy Center

"The earlier split decision by the Court of Appeals to overturn the District of Columbia’s handgun ban was not only contrary to the overwhelming weight of legal authority, but would certainly increase gun death and injury among District residents while also increasing the risks faced by the law enforcement personnel who protect all residents and workers in Washington, DC."

Of course, the Supreme Court could choose to sidestep a "roll call" on the issue by choosing not to hear the appeal, which would result in the lower court ruling overturning the D.C. ban left standing, but only applied to a limited jurisdiction.

That might be the politically desirable alternative for the Republican partisans on the Court who don't want to handle a hot button political issue head on in an election year.]

Former Law Enforcement Official Claims Armed Citizens are a Threat to Police Officers and — Perhaps — Themselves and Their Families

Okay, the mail has been coming in fast and furious to gunguys@gunguys.com. There's a lot of spam, of course. Either they are selling some stock that's about to explode or they are trying to get guys to pay to have a better explosion, and not of the gun shooting kind, I might add. It's a bunch of malarkey.

But amidst the tacky marketing, we are getting a lot of strong opinions on the gun issue. Well, it’s really the gun violence issue. Because no one is arguing about lamps, are they? I mean there is no National Lamp Association that has a stranglehold on Congress, is there? What makes the gun issue so hot is that people get killed and injured with guns in large numbers. You can’t say the same for lamps, can you?

Frankly, as I've said before, I wouldn't belong to the NRA for one reason alone. Belonging to the NRA is just like registering yourself as a gun owner with the federal government, because if President Bush can do warrantless data collection of any kind he wants, you can be damn sure that the FBI knows who is an NRA member. So what do they need to register gun owners for if they have the NRA list, not that I would care?

I mean, my car is registered, and I am tested to get a driver's license, right? And if driving and freedom of travel isn’t a great American right, what is?

But, I think it's damn hypocritical for the NRA to get my customers all emotionally unglued about gun owner registration, when it maintains the largest gun ownership registration list in the country?

Okay, you say, Mike, you are rambling again.

Yeah, sometimes I do that. After a couple years by myself up in the North Country, I have a habit of doing that. So, let me get back to my point here.

In the GunGuys mail, I came across this e-mail from someone who claims to be a retired law enforcement officer. Now, unlike me, the mail we post actually is sent to gunguys@gunguys.com. We can't confirm what anyone writes; we can just pass on the e-mails. They are what we receive. They are not made up by us.

So here's some correspondence that we wanted to share to start the week off. You can make up your own mind about its contents.

"Sirs:

"I retired after thirty years in local law enforcement and reading your July 13 mailbag on GunGuys caused me to want to respond.

"For the guy from Missouri who seemed to be of the sports mentality, "Yay, you lose." congratulations on your "win," I hope it doesn't bite you or yours in the ass someday.

For the "gun nut" who argues against that "crap about no guns, no crime," I would say, "fewer guns, less crime," the crimes, as such, often being committed by gun afficianados who in a fit of rage or, as their defense attorneys will argue, temporary insanity, tend to grab the nearest deadly weapon (most frequently a gun) and do away with whoever seems most handy.

After all, as we all know, a knife or a club requires some time to wield and some courage to do so because the victim might object, so guns are obviously safer for brave hearts who need reinforcement in their arguments. And besides, it can get a little bloody and messy and you might get some on you, so maybe gun supporters are neat freaks, and not so much gun lovers.

"For the well-spoken gentleman who states that police officers carry guns for protection, just as they wear bullet-proof vests, then closes his remarks with a few well chosen epithets, police officers carry weapons only after extensive training and periodic re-qualification and that "bullet-proof vests" only protect the upper torso. Oh, and that the crazy or felon with the gun almost always (in my humble experience) enjoys the advantage of that first shot. The problem is that most police gun battles occur at ten feet or less and luck often plays a huge role in the outcome. Small "protection" there.

Then there is the fellow who includes in his diatribe against "you anti-gun guys," the phrase "use lies, deceit, and ignorance to dupe the public . . . ", it is an axiom in police circles that most folks are shot (and killed) by their own weapons. I recommend that he read the published e-mail prior to his in which a New Haven, CT police officer shoots his own daughter and suggest that it would seem that even training does little to prevent poor judgment or accidents. Contrary to NRA arguments (proposed by their gun manufacturer friends) guns are lethal weapons, even in the hands of those trained to use them. Where are the lies and deceit in that incident and the ones I read about quite often in the MSM? And as for duping, well, I haven't heard of too many politicians who were not "duped" with NRA money in their hands. And what's with this phrase pushed by the NRA, a "carry permit" in vogue in state after state these days, the one we used to call "concealed weapons permit." Now if that’s not duping, nothing is!

"For all these gentlemen, I could only hope and pray they be given the opportunity, wearing a police "bullet-proof vest" if they wish, to walk up in the middle of a dark, rainy night on a car bearing a known, certifiable "crazy" and felon, knowing he has two hand guns on the seat beside him, and see if their brave little hearts don't do a little pitty-pat as they try to work out, without backup within thirty minutes, how they are going to do their duty "to protect and defend," which, given their oath includes the person in the car they're walking up on. I'm always amazed at police officers (in diminishing numbers these days, thank God) who support and defend the Second Amendment.

"I have no quarrel myself, now or ever, with long guns, except those which may be fully automatic, but with hand guns or any concealable weapon, let them all be destroyed. Not that it's likely to happen, not in this half-crazed culture which I came to know and appreciate in my years of law enforcement."

Mike Magnum:

"Sometimes I Think my Friends at the NRA and the State Rifle Association Just Stepped out of the Exorcist."

I don't see the point in getting hysterical, and I don't like it when other people do too.

So I was disappointed to find out that after living in the Canadian North Country for a couple of years, things hadn't changed with my buds in the gun lobby.

One of my customers shared this news release from the Illinois State Rifle Association, which is affiliated with the NRA. It’s about a state senator there named Dan Kotowski, who the state rifle association appears to be in a state of apoplexy about.

Anyway, this Senator Kotowski, who used to head a group in the Lincoln State working to reduce gun violence, got a bill passed in the State Senate that would prohibit any large capacity magazines that hold more than 10 bullets. The bill would help prevent the lethality and death toll of some mass shootings.

So the Illinois State Rifle Association issued a news release on July 8th charging:

"Senator Kotowski is quickly establishing himself as the most dangerous anti-gunner in the nation. He is using every trick in the book to find a way to take your guns away from you. He doesn't care if you are a hunter, target shooter, or trap shooter. He wants to take your guns away from you. He is obsessed with the notion of a gun-free Illinois. He is obsessed with the desire to humiliate you and strip you of your guns.

I know some people who know Senator Dan and what the ISRA is doing is called demagoguery. Senator Dan Kotowski, my sources tell me, has never indicated he wants to strip anyone of their guns, humiliate gun owners, nor, in reality, introduced any bill to "strip" anyone of their guns.

This is the kind of emotionally unstable rhetoric, to be quite honest, that makes people think that some people who own guns aren't stable enough to own them.

Let's face it, with modern technology we can create guns that can do massive amounts of killing. Do we really want to let everyone have the latest in military-style weaponry? It doesn't make any sense. That's why I won't sell .50 caliber sniper rifles for instance. They are a danger to society - they only belong in the hands of law enforcement or military personnel.

I'm an American. I value liberty and freedom, but I'm not psychologically addicted to guns. It’s just a business, and I like the outdoors. But I don't want to be responsible for doing harm to our great society.

I like the guys who come into my gun shop, but I fear if some of them keep letting their emotions run ahead of reality, we are headed for some real trouble here.

If you look at Senator Kotowski’s bill, it would leave my gun cases full, even if it became law. No one is going to run out of guns to sell, so what’s with the Halloween scare tactics?

I don't know, if this kind of virus keeps infecting the gun lobby, I might just go back up North to Canada, where the people hunt and shoot, but aren’t rabid about the whole gun culture thing.

It's kind of gotten out of hand down here. What are groups like the Illinois State Rifle Association going to do next, accuse people like Senator Dan of wanting to seize the first born of gun owners?

Also notice the “liquor” designation in his so called “business” a common lie of the gun grabbers is that ALL gun owners get drunk before hunting and shooting therby increasing gun accidents.
