The Senate last night codified into law the power of the U.S. military to indefinitely detain an American citizen with no charge, no trial and no oversight whatsoever with the passage of S. 1867, the National Defense Authorization Act.

Detention

One amendment that would have specifically blocked the measures from being used against U.S. citizens was voted down and the final bill was passed 93-7.

Another amendment introduced by Senate Intelligence Committee Chairman Dianne Feinstein that attempted to bar the provision from being used on American soil, an effort to ensure “the military won’t be roaming our streets looking for suspected terrorists,” also failed, although Feinstein voted in favor of the bill anyway.

Feinstein was able to include a largely symbolic amendment which states that “nothing in the bill changes current law relating to the detention of U.S. citizens and legal aliens,” but this measure is meaningless according to Republican Congressman Justin Amash, a fierce critic of the bill.

“Some have asserted that Sen. Feinstein’s amendment, S Amdt 1456, protects the rights of American citizens and preserves constitutional due process. Unfortunately, it does not. It’s just more cleverly worded nonsense,” Amash wrote on his Facebook page.

Though the White House has threatened to veto the bill, the fact that Obama administration lawyers yesterday reaffirmed their backing for state sponsored assassination of U.S. citizens would suggest otherwise. Not voting for the bill, or in other words upholding the oath to protect the Constitution, has been described over and over again as “political suicide”.

“The bill puts military detention authority on steroids and makes it permanent, American citizens and others are at greater risk of being locked away by the military without charge or trial,” said Christopher Anders, senior legislative counsel for the American Civil Liberties Union.

As Spencer Ackerman highlights, the bill completely violates the sixth amendment in that it allows American citizens to be locked up indefinitely, including in a foreign detention center, without any burden of proof whatsoever. An American merely has to be declared a terrorist and they can be abducted off the streets and never seen again.

“The detention mandate to use indefinite military detention in terrorism cases isn’t limited to foreigners. It’s confusing, because two different sections of the bill seem to contradict each other, but in the judgment of the University of Texas’ Robert Chesney — a nonpartisan authority on military detention — “U.S. citizens are included in the grant of detention authority,” writes Ackerman.

Poster Comment:

93 out of 100 senators are anti-American traitors, and jack booted thug tyrants.

They can just call anyone a "terrorist" and lock them away forever with no trial, judge, or jury.

Fortunately this hasn't passed the house yet, or been signed into law by our Kenyan substitute for a president. (1 image)

It's probably his menagerie of pictures of various animals throwing feces that I have turned off. He seems to yearn for his prepotty training childhood days and posts reminders as his tagline.

Of course it could be a false premise to assume that he's is actually potty trained at this point in his life

He's got to remove it.

I just tried to post you at a thread he's on and it did it again.

But that's really very appropriate Top 1% behaviour. ;}

" More and more, nationally, as well as globally, people are catching on to the machinations of the 1%, to the scams of crime syndicates such as Wall Street and the IMF, to the means by which we have been coerced, by debt enslavement to neoliberalism's global company store, into spending the fleeting days of this finite life working for the inequitable power, wealth and privilege of these ruthless few.

At present, growing numbers have taken heed of the situation and are fighting back. Within the span of a few short months, the narrative of the corporate media has, to a limited extent, been altered. Yet, at this point, the development is merely background noise: The neoliberal order is collapsing; capitalism itself is nearly at the end of its five hundred year run."

Unless I'm mistaken, the House has already passed their version of this bill.

You ought to be used to disappointment by now, considering the utter stupidity of your posts. BTW, Carolla's comments are largely about morons like you.

As usual, you're wrong.

Here is what is on my tagline. Enjoy.

You or someone fixed something.

Thanx...

Now where were we... o yeah...your insolvent buddies get bailouts, the Bottom 99% get Free Markets...

" On October 1, 2002, USNORTHCOM's establishment was step one to militarizing America.

The November 25, 2002 Homeland Security Act (HSA) centralized unprecedented executive branch military and law enforcement powers.

The October 17, 2006 Military Commissions Act scrapped habeas protections for domestic and foreign enemies alike, citizens and non-citizens, stating:

" "Any person is punishable... who....aids, abets, counsels, commands, or procures" and in so doing helps a foreign enemy, provides "material support" to alleged terrorist groups, engages in spying, or commits other offenses previously handled in civil courts.

It also authorized torture and empowered presidents to convene military commissions to try anyone called "unlawful enemy combatants." They now designated "unprivileged enemy belligerents."

On the same date, little know FY 2007 NDAA provisions (Sections 1076 and 333) amended the Insurrection Act of 1807 and Posse Comitatus Act of 1878."
